Pursuant to Clause 5, Article 81 of Decree 100/2019/NĐ-CP stipulating regulations on the deprivation of the right to use a license or certificate of practice for a limited period of time or the suspension of activities for a limited period of time in the field of road and rail transportation as follows:

4. During the period of deprivation of the right to use a license or certificate of practice, if an individual or organization still carries out the activities listed in the license or certificate of practice, they shall be punished as if they do not have a license or certificate of practice.
5. In the event that a person who commits an offense is subject to the penalty of deprivation of the right to use a license or certificate of practice, but the remaining validity period of that license or certificate of practice is less than the period of deprivation, the competent authority shall still issue a decision to impose a penalty that applies the form of deprivation of the right to use a license or certificate of practice in accordance with the regulations for the offense. During the period of deprivation of the right to use a license or certificate of practice, individuals and organizations are not allowed to apply for a reissue or a new license or certificate of practice.

Therefore, when an individual commits a traffic violation and the validity period of their driver license is less than the period of deprivation, the competent authority will still issue a decision to punish the deprivation of the right to use the driver's license.
