Instructions for Vehicle Title Transfer When the Owner has Passed Away
1. Legal Basis: Civil Code 2015; Circular 229/2016/TT-BTC; Circular 58/2020/TT-BCA;
2. Conditions:
In this case, the person carrying out the title transfer procedure will need to go through the inheritance declaration procedure at the notary office.
According to Article 651 of the Civil Code 2015:
Heirs by law are stipulated in the following order:
a) The first-line heirs include: spouse, biological father, biological mother, adoptive father, adoptive mother, biological children, adopted children of the deceased;
Since you are the spouse, you will inherit by law.
3. Documentation:
- ID Card;- Vehicle registration application form (as per the Police Department’s template);- Vehicle registration certificate;- Vehicle transfer document (inheritance document as per legal regulations);- Proof of payment of registration fee.
4. Method of Submission: Submit documents directly.
5. Processing Agency:
- Traffic Police Department, Road and Railway Traffic Police Department of provincial and central-affiliated cities;- District, town, district-level city police under the provincial department;
6. Processing Time: Within 02 working days from the date of receiving complete and valid documents;
7. Fees: According to Circular 229/2016/TT-BTC
Regulations on License Plates
Article 25 Clause 3 of Circular 58/2020/TT-BCA stipulates license plate regulations as follows:
- Cars are required to have 02 short license plates with the dimensions: height 165 mm, length 330 mm. In cases where the vehicle’s design or particular characteristics do not allow for 02 short plates, the vehicle registration authority will inspect and propose to the Head of the Traffic Police Department (for vehicles registered at the Traffic Police Department) or the Head of the local Traffic Police Division for a change to 02 long license plates with dimensions: height 110 mm, length 520 mm or 01 short plate and 01 long plate. The arising costs are the responsibility of the vehicle owner.
a) Arrangement of characters and numbers on domestic license plates: The first two digits are the local registration codes, followed by the registration series (letters); the second group of numbers is the registration order consisting of 05 natural digits from 000.01 to 999.99;
b) Arrangement of characters and numbers on foreign vehicle license plates: The first two digits are the local registration codes, followed by the second group which is the country code, international organization code consisting of 03 natural digits and the third group being the series indicating the group of foreign organizations, individuals, and the fourth group is the registration order consisting of 02 natural digits from 01 to 99;
c) Trailer and semi-trailer license plates consist of 1 plate attached to the rear of the vehicle, dimensions: height 165 mm, length 330 mm; the arrangement of characters and numbers on the license plate is the same as on domestic car license plates.
