From January 1, 2025, can passengers and taxi drivers in Vietnam negotiate fares?
Based on Article 28 of Circular 36/2024/TT-BGTVT on the rights and responsibilities of taxi drivers:
Article 28. Rights and responsibilities of taxi drivers
- Wear a name badge and uniform conforming to the transport business unit's regulations.
- Collect fares from passengers at the end of the journey according to the fare meter or according to announcements on the software or as agreed upon between the passengers and the transport business unit.
- Maintain vehicle cleanliness.
- Provide route information upon passenger request; guide and assist passengers (especially persons with disabilities, the elderly, pregnant women, and children) when boarding and alighting the vehicle.
- Fulfill other responsibilities as prescribed by the Road Traffic Law and Road Traffic Safety Law.
According to the above regulation, taxi drivers collect fares from passengers at the end of the journey according to the fare meter, or according to software announcements, or as agreed upon between the passengers and the transport business unit.
Thus, from January 1, 2025, besides paying fares according to the fare meter or software, passengers and taxi drivers can pay fares based on a mutual agreement.

What are rights and responsibilities of taxi passengers in Vietnam?
Based on Article 29 of Circular 36/2024/TT-BGTVT on the rights and responsibilities of taxi passengers:
Article 29. Rights and responsibilities of taxi passengers
- Request the driver to provide information about the travel journey.
- Pay the fare according to the fare meter or software and receive an electronic invoice for the trip of the correct amount paid. In cases where the fare is mutually agreed upon between the passenger and the transport business unit, it should be calculated based on the fare table posted on the taxi or via the transport business unit's fare calculation software for passenger transport by taxi.

What are types of passenger transport by automobile in Vietnam?
Based on Article 56 of the Road Traffic Law 2024 on road transport activities:

- Transport business by automobile, by motorized four-wheeled vehicles includes passenger transport and goods transport. Transport business by automobile, by motorized four-wheeled vehicles is the organizing by individuals or entities of at least one of the stages which include: managing vehicles and drivers or determining transport fares to transport passengers or goods on roads for profit, except for internal transport activities specified in clause 12 of this Article.
- Passenger transport business by automobile includes: fixed-route passenger transport, public passenger transport by bus, passenger transport by taxi, contract-based passenger transport, and new passenger transport business types as regulated by the Government of Vietnam.
- Fixed-route passenger transport is a type of passenger transport business using automobiles with 08 or more seats (excluding the driver's seat) to transport passengers, determining the departure bus station and arrival bus station with a set route and schedule.

- Public passenger transport by bus
- Passenger transport by taxi
