Article 57. Driver license

  1. Driver licenses include the following classes:

a) Class A1 is issued for drivers of two-wheeled motorcycles with a cylinder capacity of up to 125 cm3 or an electric motor power of up to 11 kW;

b) Class A is issued for drivers of two-wheeled motorcycles with a cylinder capacity exceeding 125 cm3 or an electric motor power exceeding 11 kW and types of vehicles specified for a Class A1 driver license;

c) Class B1 is issued for drivers of three-wheeled motorcycles and types of vehicles specified for a Class A1 driver license;

Pursuant to Article 59 of the 2024 Road Traffic Safety Law, the age and health of vehicle operators participating in road traffic is stipulated as follows:

Article 59. Age and health of vehicle operators participating in road traffic

  1. The age for drivers and operators of specialized motorcycles is regulated as follows:

a) Individuals aged 16 and above are permitted to operate mopeds;

b) Individuals aged 18 and above are eligible for Class A1, A, B1, B, C1 driver licenses and for certification in legal knowledge on road traffic to operate specialized motorcycles in road traffic;

c) Individuals aged 21 and above are eligible for Class C, BE driver licenses;

According to the above regulation, individuals aged 18 and above are eligible for a Class B1 driver license.

What are prohibited acts in road traffic safety and order in Vietnam?

Pursuant to Article 9 of the 2024 Road Traffic Safety Law, prohibited acts in road traffic safety and order include:

- Operating motor vehicles in road traffic without a driver license as legally required; operating specialized motorcycles in road traffic without a driver license or certification in legal knowledge on road traffic, or without a certificate for operating a specialized motorcycle.

- Operating vehicles in road traffic with alcohol concentration in the blood or breath.

- Operating vehicles in road traffic with illegal drugs or other prohibited substances in the body.

- Insulting, threatening, obstructing, resisting, or failing to comply with orders, guidance, inspection, and control requests by law enforcement officers on maintaining road traffic order and safety.

- Illegal racing, organizing illegal racing, inciting, aiding, or cheering for illegal racing; operating vehicles in road traffic dangerously or continuously revving engines.

- Handling and using mobile phones or other electronic devices while operating a vehicle in motion on the road.

- Entrusting motor vehicles or specialized motorcycles to individuals who do not meet the legal conditions to operate vehicles in road traffic.

- Bringing motor vehicles or specialized motorcycles that do not meet legal technical safety and environmental protection standards, or other vehicles that do not meet legal conditions, into road traffic.

- Importing, manufacturing, assembling motor vehicles or specialized motorcycles that do not meet legal requirements for technical safety and environmental protection.

- Illegally modifying vehicles of other types into passenger vehicles, except for modifications serving defense and security purposes.

- Unauthorized modifications; intentional tampering with mileage indicators on cars; illegally altering, grinding, or restamping frame or engine numbers of motor vehicles or specialized motorcycles.

- Intentionally tampering with or altering vehicle control software of registered vehicles to cheat inspection, testing, or assessments; borrowing or renting motor vehicle parts only for inspection purposes.

- Overloading with goods exceeding allowable vehicle or road capacity as regulated or without meeting legal requirements; transporting goods without legal fastening as required or overloading passengers beyond legal stipulations.

- Transporting prohibited or unlawfully traded goods, or not complying fully with legal provisions on transporting dangerous goods or wild animals.

- Threatening, insulting, competing for, or enticing passengers; coercing passengers to use unwanted services; transferring, unloading passengers or conducting other actions to evade detection of overloading or excess passengers beyond legal standards.

- Installing and using sound and light equipment on motor vehicles or specialized motorcycles causing disorder and road traffic safety issues.

- Illegally producing, using, buying, selling vehicle license plates; operating vehicles with license plates not issued by competent authorities, affixing them improperly; bending or obscuring vehicle license plates; altering letters, numbers, colors, shapes, dimensions on license plates.

- Interrupting operation or falsifying data of journey monitoring devices or cameras installed on vehicles as per regulations.

- Destroying, damaging, or disabling devices for controlling, monitoring road traffic or smart devices aiding traffic control and command.

- Illegally placing obstacles or barriers on roads; scattering sharp objects, pouring slippery substances; littering stones, goods, construction materials, waste on roads; discharging waste or hazardous materials causing traffic safety issues.

- Obstructing individuals or vehicles participating in road traffic; throwing bricks, stones, sand, or other objects at individuals or vehicles participating in road traffic.

- Abusing road traffic safety responsibilities to violate laws, harass, infringe on the state’s, organization’s, or individual’s rights and lawful interests.

- Using positions, authority, or professional influence of oneself or others to break the law on road traffic order and safety or to intervene in the processing of legal violations regarding road traffic order and safety.

- Utilizing the rights of priority vehicles when not performing duties as per law; installing or using priority signal devices not accordance with the law.

- False reporting or misrepresentation or providing incorrect information, documents to evade responsibility when detected violating road traffic laws.

- Fleeing after causing road traffic accidents to evade responsibility; deliberately not aiding road traffic accident victims; infringing upon the life, health, property of victims, accident causers, or helpers; exploiting road traffic accidents to assault, threaten, incite, exert pressure, or obstruct traffic accident handling.

- Operating UAVs, unmanned aerial vehicles, ultra-light vehicles within road boundary limits causing obstructions or safety risks, except for permitted UAVs or ultra-light vehicles.

- Other acts violating road traffic rules.
