What types of vehicles are considered motor vehicles in Vietnam?
Based on Article 34 of the Road Traffic Safety and Order Law 2024 on the classification of road transportation vehicles:
Article 34. Classification of road transportation vehicles
- Motor vehicles include:
a) Automobiles include: vehicles with four or more wheels driven by an engine, designed and manufactured to operate on roads, not on tracks, used for transporting people, goods, towing trailers, semi-trailers, or specially constructed to perform specific functions and may be connected to overhead electric lines; three-wheeled vehicles with an unladen weight of more than 400 kg; automobiles do not include four-wheeled motorized passenger vehicles and four-wheeled motorized cargo vehicles;
b) Trailers are non-engine vehicles designed and manufactured to operate on roads, towed by automobiles; the main part of the total weight of the trailer is not placed on the towing vehicle;
c) Semi-trailers are non-engine vehicles designed and manufactured to operate on roads; towed by tractor units and a significant portion of the total weight is placed on the tractor unit;

Motor vehicles include the following types:
- Automobiles include:
+ Vehicles with four or more wheels driven by an engine, designed and manufactured to operate on roads, not on tracks, used for transporting people, goods, towing trailers, semi-trailers, or specially constructed to perform specific functions and may be connected to overhead electric lines
+ Three-wheeled vehicles with an unladen weight of more than 400 kg
+ Automobiles do not include four-wheeled motorized passenger vehicles and four-wheeled motorized cargo vehicles

- Four-wheeled motorized cargo vehicles are vehicles with four or more wheels, driven by an engine, designed and manufactured to operate on roads, constructed to carry goods, with the engine and cargo compartment installed on the same vehicle frame, having a maximum of two rows of seats and carrying up to 5 people (excluding the driver), with a designed speed not exceeding 60 km/h and an unladen weight not exceeding 550 kg; in the case of vehicles using electric engines, the engine power does not exceed 15 kW;
- Motorcycles include: vehicles with two or three wheels driven by an engine, designed and manufactured to operate on roads, excluding mopeds; for three-wheeled vehicles, the unladen weight does not exceed 400 kg;
- Mopeds are vehicles with two or three wheels driven by an engine, designed and manufactured to operate on roads, with a design speed not exceeding 50 km/h; if the driving engine is a combustion engine, the working or equivalent displacement does not exceed 50 cm3; if the driving engine is electric, the engine power does not exceed 4 kW; mopeds do not include motorized bicycles;
- Vehicles similar to the above types

Based on Article 6 of Circular 38/2024/TT-BGTVT on the maximum speed for motor vehicles participating in traffic on roads (excluding highways) as follows:
[1] Maximum allowable speed for motor vehicles participating in traffic on roads within densely populated areas
[2] Maximum allowable speed for motor vehicles participating in traffic on roads outside densely populated areas
In which situations is overtaking not allowed according to the law in Vietnam?
Based on Clause 6, Article 14 of the Road Traffic Safety and Order Law 2024, overtaking is not allowed in the following situations:
- When overtaking conditions are not ensured
- On narrow bridges with a single lane
- In curves with restricted visibility
- On two-way roads at peak areas with restricted visibility
- At intersections, road crossings on the same level with railways
- When weather or road conditions do not ensure safety for overtaking
- When encountering priority vehicles
- On pedestrian crossings
- When there are pedestrians, or wheelchairs for persons with disabilities crossing
- In road tunnels
