Duties of the Transportation Operator When the Vehicle is Operating on the Road as Specified in Clause 5, Article 4, Circular 12/2020/TT-BGTVT. To be specific:
- The traffic safety management department (staff) or the transportation operator or the management staff assigned by the unit must carry out the following tasks: monitor the operation of the vehicle and the driver throughout the transportation service by using journey monitoring devices; promptly remind the driver upon detecting the vehicle exceeding speed limits, exceeding continuous driving time, exceeding the working hours in a day, deviating from the transportation itinerary, the journey monitoring device being without signal, and other risks causing traffic safety issues; receive and propose solutions when incidents causing traffic safety issues occur. Information about reminders and admonishments when the driver violates should be recorded or updated into the unit’s software for tracking;
- The driver must strictly comply with the regulations on traffic safety during the operation of the vehicle to transport passengers and goods, adhere to the regulations on continuous driving time, daily working hours of the driver, speed limits, driving routes, ensuring that journey monitoring devices and cameras (for vehicles required to install) are always operational; immediately report the time, location, and cause when a traffic safety incident occurs so the unit can promptly take corrective measures.
