Does it take long time for reissuance of vehicle registration in Vietnam?

Pursuant to Article 4 of the Circular 58/2020/TT-BCA stipulating time limit for the issuance of vehicle registration and license plates as follows:

1. The license plate shall be issued or replaced immediately after receiving a duly completed application.

2. Issuance of temporary vehicle registration certificates and temporary license plates: to be completed within a day.

3. Initial issuance and replacement of vehicle registration certificates, issuance of certificates of revocation of vehicle registration and license plate: not exceeding 2 working days, after receiving a duly completed application.

4. Re-issuance of license plate which is lost, blurry or broken: not exceeding 7 working days, after receiving a duly completed application.

5. Re-issuance of the vehicle registration certificate that has been lost: not exceeding 30 working days, after receiving a duly completed application.

As regulations above, re-issuance of the vehicle registration certificate that has been lost shall be within 30 working days, after receiving a duly completed application.

Which authorities shall receive application for reissuance of vehicle registration in Vietnam?

Pursuant to Article 3 of the Circular 58/2020/TT-BCA (amended by Clause 1 Article 3 of the Circular 15/2022/TT-BCA) stipulating vehicle registration authority as follows:

1. The competent vehicle registry shall manage and keep records as prescribed, information about vehicles is consistently managed on the registration database of the Department of Traffic Police.

2. The competent vehicle registry must have direction diagrams and citizen reception schedule, and be located in a place convenient for receiving and processing applications and procedures for vehicle registration, have seats, a parking lot, mailbox, desk name plates for officers in charge of vehicle registration and publicly post up regulations governing procedures for vehicle registration, vehicle registration fees, violations against regulations on vehicle registration and issuance of license plates and respective punishment.

3. Department of Traffic Police shall register and issue the license plate for vehicles of Ministry of Public Security, and automobiles of diplomatic missions, consular offices and representative offices of international organizations and foreign nationals working for these ones; automobiles owned by agencies and organizations as stipulated at the Appendix No.01 of this Circular.

4. The Traffic Police Divisions, the Road and Rail Traffic Police Divisions and the Road Traffic Police Divisions controlled by the Police Departments of provinces and centrally-affiliated cities (hereinafter referred to as Traffic Police Division) shall grant registrations and number plates to car, tractors, trailers, semi-trailers and others having the same structures thereof under the ownership of foreign agencies, organizations and individuals; of projects and economic organizations in partnership with foreign entities that are locally operated, agencies, organizations, enterprises, military enterprises, individuals whose offices or permanent addresses are in districts and centrally-affiliated cities or provincially-affiliated cities where Traffic Police Divisions’ offices are located (except types of vehicles under the ownership of agencies, organizations and individuals specified in clause 3 of Article 3 herein).

5.Police Divisions of districts, towns, provincially or centrally-affiliated cities (hereinafter referred to as district Police) shall grant registration application and number plates to the following vehicles (except types of vehicles of agencies, organizations, enterprises, military enterprises and individuals specified in clause 3, 4 and 6 of Article 3 herein):

Cars, tractors, trailers, semi-trailers and other similar vehicles under the ownership of domestic agencies, organizations, enterprises, military enterprises or individuals whose offices or permanent residence addresses are located under their jurisdiction.

Cars, motorbikes (including electric bikes) and other similar vehicles under the ownership of domestic agencies, organizations, enterprises, military enterprises or individuals whose offices or permanent residence addresses are located under their jurisdiction; foreign agencies, organizations, individuals, projects or economic organizations in partnership with foreign entities that fall within their remit.

Conditions, authority and duration of completion of delegation of authority to grant vehicle registration and number plates of district-level Police Divisions shall be subject to clause 6 of Article 26 herein.

6. Police of communes, wards or towns (hereinafter referred to commune-level Police) grants vehicle registration and number plates to motorbikes (including electric bikes) under the ownership of domestic agencies, organizations, enterprises, military enterprises or individuals whose offices or permanent residence addresses are located under their jurisdiction; foreign agencies, organizations, individuals, projects or economic organizations in partnership with foreign entities that fall within their remit; withdraws certificates of the vehicle registration or number plate with respect to the vehicles whose useful life expires, vehicles damaged to the extent of being out of order of agencies, organizations or individuals whose offices or permanent residence addresses are located within their jurisdiction.

Conditions and authority to grant vehicle registration and number plates of commune-level Police Divisions shall be subject to clause 6 of Article 26 herein.

Do police officers have to instruct the vehicle owner to perform procedures of reissuance of vehicle registration in Vietnam?

Pursuant to Article 5 of the Circular 58/2020/TT-BCA stipulating responsibilities held by officers in charge of the vehicle registration as follows:

1. Comply with legal regulations of this Circular and other relevant laws pertaining to the vehicle registration.

2. Instruct the vehicle owner to perform certain procedures for vehicle registration as per the law; receive the application for vehicle registration after checking and comparing the application and corresponding vehicle in reality as per the law. Where the application is not deemed duly completed as required, they must provide the registrant with sufficient and thorough instructions.

3. Receive application for vehicle registration and issuance of license plate after the vehicle owner restores the origin of vehicle which violates security regulations: intentionally changing paint, drawing, advertisement, installation of equipment on the vehicle, change of function of the vehicle as per the law.

As regulations above, the police shall guide vehicle owners to carry out vehicle registration procedures in accordance with the law.
