Contract for motorcycle purchase dated from December 2020: Is it possible to transfer ownership now?
Can a motorcycle purchase contract established in December 2020 be transferred now?
According to Clause 2, Article 8 of Circular 58/2020/TT-BCA, it is stipulated:
- Documents for the transfer of vehicle ownership, including one of the following documents:
a) Invoice, financial documents (receipt, voucher) or documents for purchase, donation, or gifting of the vehicle (decision, contract, inheritance document) in accordance with the law;
b) Sale, donation, or gifting document of the vehicle from an individual with notarization or certification or confirmation from the agency, organization, unit of employment for armed forces personnel and foreigners working in diplomatic missions, consular offices, representative offices of international organizations who register the vehicle under the address of their workplace;
c) For decommissioned police vehicles: The decision for decommissioning the vehicle from the competent authority and the invoice for selling public assets or the invoice for selling state assets;
d) For decommissioned military vehicles: Vehicle registration certificate, official letter confirming the vehicle has been removed from military equipment by the Department of Vehicles - Machines, Ministry of Defense, and the invoice for selling public assets or the invoice for selling state assets.
Thus, currently, the law does not stipulate the completion time for the purchase contract. Therefore, you can go to the competent authority to proceed with the transfer of ownership without needing to establish a new contract.
Motorcycle ownership transfer fee
According to Article 5 of Circular 229/2016/TT-BTC, the fee for issuing a replacement registration certificate for motorcycles is stipulated as follows:

Thus, the fee for transferring motorcycle ownership is 50,000 VND per transfer per vehicle, applicable in Region I, Region II, and Region III. However, motorcycles moving from an area with a lower fee to an area with a higher fee will apply according to point 4.1, clause 4, Article 5 of Circular 229/2016/TT-BTC.
