Circular 41/2024/TT-BGTVT regulating the management, operation, exploitation, maintenance, and protection of road infrastructure structures in Vietnam
On November 15, 2024, the Minister of Transport of Vietnam issued Circular 41/2024/TT-BGTVT, including:
- Procedures for approving the design and procedures for issuing construction permits for intersections connected to national highways under operation.
- Authority, procedures, content of issuance of construction permits for works on roads under operation; responsibilities for providing information and a coordination mechanism among related agencies, organizations, and individuals to ensure traffic order, safety, and safety during construction.
- Management, operation, exploitation, and maintenance of road infrastructure.
- Operations of vehicle weight control works.
Circular 41/2024/TT-BGTVT applies to organizations and individuals involved in:
- Procedures to approve the design and issue construction permits for intersections connected to national highways under operation.
- Procedures for issuing construction permits for works on roads under operation.
- The provision of information, coordination mechanism between agencies, organizations, individuals to ensure traffic order, safety, and safety during construction.
- Management, operation, exploitation, and maintenance of road infrastructure.

What documents are included in the maintenance dossier for road infrastructure in Vietnam?
Based on Article 7 of Circular 41/2024/TT-BGTVT, maintenance process records for road infrastructure are stipulated as follows:
Article 7. Maintenance Process Records for Road Infrastructure
- Maintenance records for road infrastructure include:
a) The documents specified in Clause 8, Article 34 of Decree No. 06/2021/ND-CP; technical regulations, standards on maintenance of road infrastructure works;
b) Regulations on supervision, acceptance of the maintenance results for road infrastructure according to quality implementation.
- The investor is responsible for preparing and approving the maintenance process of road infrastructure during the technical design or construction drawing design step, except as stipulated in Clause 1, Article 8 of this Circular.

Thus, the maintenance records for road infrastructure are prepared to include:
- Documents serving maintenance work, including maintenance procedures of construction works, completed drawings, equipment history installed into the works, and necessary documents for maintenance of construction works.
- The investor is responsible for transferring maintenance documents to the owner or the manager, user of the works before handing over the works for exploitation and use.
- Maintenance plan
- Results of regular and periodic inspections of the works
- Results of maintenance and repairs of the works
- Results of observation, quality inspection results of the works (if any)
- Results of safety and operational assessments of the works during exploitation and use (if any)
- Other related documents
- Technical regulations, standards on maintenance of road infrastructure works
- Regulations on supervision, acceptance of the maintenance results for road infrastructure assets according to the quality implementation.
What are types of roads determined by management level in Vietnam?
Based on Article 8 of Road Law 2024, roads are classified by management level into: national highways, provincial roads, district roads, commune roads, village roads, urban roads, dedicated roads, and are defined as follows:
- National highways are roads connecting the capital, Hanoi, with provincial administrative centers; roads connecting provincial administrative centers; roads that hold important positions for the economic-social development, and ensure national defense and security of the region, and area.
- Provincial roads are roads within a province connecting the provincial administrative center with the district administrative center; roads of significant importance for the economic-social development of the province.
- District roads are roads connecting the district administrative center with the commune, cluster of communes, or neighboring district administrative centers; roads of significant importance for the economic-social development of the district.
- Commune roads are roads connecting the commune administrative center with hamlets, villages, settlements, and rural residential points or roads connecting with neighboring communes; roads of significant importance for the economic-social development of the commune.
- Village roads are roads within a village, trunk roads connecting the village with agricultural, forestry production areas, and other production and business establishments in the village area.
- Urban roads are roads within the administrative boundaries of inner city, inner town, including: urban highways, streets, alleys, lanes, paths within urban areas.
- Dedicated roads are roads specifically serving the traffic of one or several agencies, organizations, individuals, and internal roads.
