Can traffic police request citizens to present their citizen identity cards in Vietnam? Do people have to present a citizen identity card when being administratively sanctioned in Vietnam?

Hello, I have an issue that needs clarification. On July 21, I was stopped by traffic police on Truong Chinh street to check my vehicle documents. The traffic police asked for my citizen identity card, I thought if they were checking vehicle documents, they only needed to check the driver's license, vehicle insurance, or vehicle registration papers. Can traffic police request citizens to present their citizen identity cards in Vietnam?

According to Point a Clause 2 Article 10 Circular 65/2020/TT-BCA regulating the content of control as follows:

a) Control documents related to individuals and vehicles, including: Driver's license; Certificate of legal knowledge training on road traffic, Specialized driving license or certificate for motorbikes; Vehicle registration certificate; Certificate of technical safety and environmental protection inspection for motor vehicles, specialized motorbikes (for types of vehicles required to be inspected); Civil liability insurance certificate of the vehicle owner and other related documents as prescribed by law;

Therefore, besides the documents related to traffic, traffic police have right to request citizens to present other related documents in Vietnam. In case the traffic police request you to present your citizen identity card, you have the obligation to present it.

At Clause 2 Article 56 of the Law on Handling of Administrative Violations 2012 stipulates administrative sanction without record taking as follows:

2. Decisions of administrative sanctions on the spot must be written clearly the information of date of decisions; full name, address of violators or name, address of violating organizations; acts of violations; venues of violations; evidences and details related to the violation settlement; full name, position of persons who make sanctioning decisions; articles, clauses of applicable legal documents. In case of fines, there must be the fine levels in the decisions.

Based on Clause 3 Article 58 of the Law on Handling of Administrative Violations 2012 amended by Clause 29 Article 1 of the amended Law on Handling of Administrative Violations 2020 stipulates making records of administrative violations as follows:

3. An administrative violation record must contain the following main information:

a) Recording time and venue;

b) Information about the record maker, violating person or entity, individuals or entities involved;

c) Time and location when and where the violation occurs; case or violation description;

d) Testimony of the violator or representative of the violating entity, the witness, the victim or representative of the organization suffering loss or damage;

dd) Injunction and guarantee measures;

e) Rights and duration of explanation.

Therefore, information about the full name, address of the violator, the citizen identity card is the most accurate basis to verify that information. Presenting the citizen identity card to the police when being administratively sanctioned is necessary.
