Can Toll Station Employees Issue Traffic Violation Records?
Article 79 of Decree 100/2019/ND-CP stipulates:
The authority to record administrative violations in the field of road traffic includes:
- Positions with the authority to impose administrative sanctions in the field of road traffic as stipulated in Articles 75, 76, and 77 of this Decree;
- Public officials and public employees assigned with patrol duties have the authority to record violations related to the infringement of road traffic infrastructure; encroachment, unauthorized use of road land, and road traffic safety corridors;
- Police officers have the authority to record violations occurring within their local jurisdiction;
- Public officials belonging to the Inspectorate of the Department of Transport performing their official duties have the authority to record violations occurring within the management area of the Department of Transport Inspectorate;
- Public officials and public employees under the Maritime Administration, Aviation Administration, and Inland Waterway Ports Administration performing their official duties have the authority to record violations stipulated in point a, clause 1, clause 3, clause 5 of Article 28 of this Decree when occurring within the management area of the port administration.
Thus, according to this regulation, toll station employees do not have the authority to record traffic violations.
