Can a Traffic Violation Car Whose Owner Has Not Completed the Fine Obligation Be Inspected?
Point a Clause 3 Article 9 Circular 16/2021/TT-BGTVT stipulates the Certificate of Inspection, Inspection Sticker as follows:
Motor vehicles are issued a Certificate of Inspection, Inspection Sticker with a validity period of 15 days when the inspection meets requirements in the following cases:
+ Motor vehicles are warned on the Inspection Management Program according to the provisions of Clause 12 Article 80 of Decree No. 100/2019/ND-CP.
According to Clause 12 Article 80 of Decree 100/2019/ND-CP, the provisions are as follows:
In cases where the deadline for resolving the violation recorded in the administrative violation record or the notification document of the competent authority has passed and the owner of the vehicle (car, trailer, semi-trailer, specialized motorcycle) involved in the violation has not come to the headquarters of the competent authority to resolve the issue, the competent authority shall send a notification to the inspection agency to issue a warning for the vehicle involved in the administrative violation on the Inspection Management Program.
When the vehicle comes for inspection, the inspection agency informs the person bringing the vehicle for inspection about the violation, conducts the inspection according to the regulations for the vehicle, and issues a Certificate of Inspection and a technical safety and environmental protection Inspection Sticker with a validity period of 15 days.
After the violator has come to the headquarters of the competent authority to resolve the violation according to the regulations, the competent authority must immediately send a notification to the inspection agency to remove the warning for the vehicle involved in the administrative violation on the Inspection Management Program, conduct the inspection, and issue a Certificate of Inspection and a technical safety and environmental protection Inspection Sticker according to current regulations for the vehicle.
Therefore, in this case, you have been notified by the competent authority regarding the decision to impose a penalty, but you have not yet complied to resolve the violation. Based on the above regulations, you can still bring the vehicle for inspection; however, the inspection certificate issued will have a validity period of only 15 days.
