Born in 2005, Is It Allowed to Operate a 50cc Motorbike?
According to Point a, Clause 1, Article 60 of the 2008 Road Traffic Law which stipulates the age of drivers as follows:
Individuals aged 16 or older are permitted to drive motorcycles with a cylinder capacity of less than 50 cm³;
Based on the above provision, individuals aged 16 or older are permitted to drive motorcycles with a cylinder capacity of less than 50 cm³. Thus, as you were born on January 18, 2005, and not yet 16 years old, you are not permitted to operate a motorcycle with a 50 cm³ cylinder capacity. You will be penalized for the act of not being of legal age to operate a motorcycle.
Clause 1, Article 21 of Decree 100/2019/ND-CP stipulates penalties for violations of the conditions of motor vehicle operators:
+ Issuing a warning to individuals aged between 14 and under 16 who operate a motorcycle, moped (including electric bicycles), and similar motor vehicles or who operate an automobile, tractor, and similar vehicles.
Additionally, according to Clause 5, Article 30 of this Decree, the regulations are as follows:
A fine ranging from VND 800,000 to VND 2,000,000 for individuals, and from VND 1,600,000 to VND 4,000,000 for organizations that are the owners of motorcycles, mopeds, and similar vehicles for one of the following violations:
Allowing or entrusting a vehicle to an individual who does not meet the conditions stipulated in Clause 1, Article 58 of the Road Traffic Law to operate the vehicle in traffic (including cases where the driver holds an expired driving license or is currently suspended from driving);
