According to the law in Vietnam, is it permissible to get on the plane when being drunk? What are the fines for bringing alcohol beverages on the plane in Vietnam?
Hello Lawnet. On August 12, I had a flight from Da Nang to Da Lat. The flight was not very comfortable because the passenger sitting next to me was drunk. May I ask if drunk people are allowed to get on the plane?

Pursuant to Article 58 of the Circular 13/2019/TT-BGTVT (amended by Clayse 37 Article 1 of the Circular 41/2020/TT-BGTVT) stipulating security inspection of passengers who have lost their act control capacity as follows:
1. A passenger who has lost his/her act control capacity is a passenger who loses consciousness or control over his/her acts due to his/her mental disorder or use of alcoholic beverages or stimulants.
2. The transport of passengers having mental disorder shall be considered and decided by the airline representative. In case of accepting transport, the following requirements shall be satisfied:
a) Passengers having mental disorder shall be accompanied by their doctors or relatives who are able to control their abnormal acts. Where necessary, passengers having mental disorder shall be anaesthetized before embarking the aircraft. The duration of the flight must not be longer than the effective period of the medicine;
b) Passengers having mental disorder and their baggage and items shall undergo a manual check. The manual check may be conducted in a separate area;
c) Where necessary, the aviation security control force shall escort passengers having mental disorder to the aircraft and vice versa at the request of the airline representative;
d) The airline representative shall inform the pilot-in-command of the seats of passengers having mental disorder. Where necessary, the pilot-in-command shall notify the aircraft/aerodrome operator in the area where the aircraft is expected to land of necessary assistance.
3. The airline representative shall consider and decide the transport of passengers having used alcoholic beverages or stimulants but not to such an extent that they lose their act control capacity. Upon transporting such passengers, the airline must take appropriate aviation security control measures.
As regulations above, a person who has lost his/her act control capacity due to use of alcoholic beverages or stimulants are not allowed to get on the plane in Vietnam. In your case, the passenger sitting next to you may still have the act control capacity and he/she was allowed to get on the plane by the airline.
What are the fines for bringing alcohol beverages on the plane in Vietnam?
Pursuant to Article 26 of the Decree 162/2018/NĐ-CP stipulating violations against regulations on aviation security control at airports and aerodromes, on flights, and at places with aviation equipment and works as follows:
1. A fine ranging from VND 100,000 (one hundred thousand) to VND 500,000 (five hundred thousand) shall be imposed for taking alcohol, alcoholic liquids and other liquids into the secure area or on an aircraft inconsistently with regulations.
2. A fine ranging from VND 500,000 (five hundred thousand) to VND 1,000,000 (one million) shall be imposed for failure to obey instructions given by aviation security control forces or aviation staff at an airport or aerodrome.
3. A fine ranging from VND 1,000,000 (one million) to VND 3,000,000 (three million) shall be imposed for threatening or reviling aviation staff, passengers or other persons at an airport or aerodrome or at place where aviation building or equipment is located.
4. A fine ranging from VND 3,000,000 (three million) to VND 5,000,000 (five million) shall be imposed for committing one of the following violations:
a) Disrupting, inciting or persuading another to cause disruption to security and safety at an airport or aerodrome, or where civil aviation building or equipment is located but the violation is not serious enough to cause the violating entity to face a criminal prosecution;
b) Entering restricted areas or boarding an aircraft without passing the appropriate gate or door, or without passing through aviation security checking or screening system;
c) Failure to lock the cockpit door throughout the flight as regulated;
d) Breaking orders and disciplines on board the aircraft;
dd) Spreading or providing false information about guns, ammunitions, bombs, mines, explosives, radioactive substances, bio-weapons or chemical weapons but the violation does not interfere with normal civil aviation operations and is not serious enough to cause the violating entity to face a criminal prosecution;
e) Taking person, luggage, cargo, package or other object which is not yet screened by the security into restricted areas in an airport or aerodrome or on an aircraft;
g) Taking person or vehicle into restricted areas in an airport or aerodrome inconsistently with regulations;
h) Using rude gestures and/or words to provoke, tease or insult aviation staff, passengers or other persons at an airport or aerodrome;
i) Threatening or reviling aviation staff or passengers on board an aircraft;
k) Hiring, persuading or inciting other people to fight each other or getting involved in a fight at an airport or aerodrome but the violation is not serious enough to cause the violating entity to face a criminal prosecution.

As regulations above, anyone bringing alcohol beverages on the plane in Vietnam shall face a fine ranging from VND 100,000 to VND 500,000.
