What is term of office of elementary school principals in Vietnam?

Pursuant to Article 11 of the Charter of Primary Schools promulgated together with Circular 28/2020/TT-BGDDT, there are regulations on principals and vice principals of primary schools as follows:

1. Principal

a) The principal of a primary school is the person responsible for the management and administration of the school's activities and educational quality.

b) Persons appointed as principals of public schools or recognized as principals of private schools must meet the standards specified in the Standard of Principals of general education institutions and satisfy the following requirements: the standard qualifications of teachers in accordance with the provisions of the Law on Education for primary schools; have taught for at least 5 years (or 4 years for mountainous, island, highland, deep-lying, remote areas, ethnic minority areas, areas with extremely difficult socio-economic conditions) at elementary school level.

c) The term of office of the principal of the primary school is 5 years. After each school year, the principal is commented by officials and employees in the school and evaluated by competent authorities according to regulations. Principal working at a public elementary school for no more than two consecutive terms.

d) Duties and powers of the principal

Develop strategies and plans for school development; plan and organize the implementation of teaching and educational plans; report and evaluate the performance results before the School Council and competent authorities.

Establish professional teams, office groups and emulation and commendation councils; Disciplinary Council, Advisory Council in the school; appoint team leaders and deputy leaders; appoint a teacher to be the General Manager of the Ho Chi Minh Young Pioneers Team.

Perform the tasks of managing officials, teachers and employees in accordance with the law and the guidance of the education management agency; develop professional capacity development plans for teachers and staff; encourage and create conditions for teachers and staff to participate in educational innovation activities; evaluate and classify teachers and staff according to regulations of the Ministry of Education and Training; participate in the process of recruiting, transferring and arranging teachers; organize steps to introduce personnel to request competent authorities to appoint vice principals.

Manage and receive students, allow students to transfer schools; decide to discipline and reward students; approve student assessment results, list of students going up to class, saving the council; organize the inspection and recognition of the completion of the primary school program for students in the school and other subjects in the school's area of ​​responsibility.

Organize the implementation of the primary school general education program according to the regulations of the Ministry of Education and Training; local textbooks and educational contents under the decision of the People's Committee of the province. Manage, use and select reference publications for use in schools in accordance with regulations of the Ministry of Education and Training.

Participate in activities with professional groups; self-study and self-improve to improve professional and management capacity. Attend training courses on politics, expertise and manage skills; participate in teaching according to the regulations on the teaching period norms applicable to the principal.

Administrate; manage and be autonomous in the use of financial resources and properties of the school according to regulations.

Organize the implementation of grassroots democracy regulations; implement the socialization of education, coordinate the organization, mobilize social forces to participate in educational activities, promote the role of the school in the social community.

Build a safe, healthy, friendly school environment, prevent and combate school violence according to the provisions of law.

Enjoy allowances for teachers and preferential policies according to regulations.

2. Vice Principal

a) The Vice-Principal is an assistant to the Principal and is responsible to the Principal; responsible for administering the work assigned by the principal; administer the school's operations when authorized by the principal.

b) Persons appointed as vice principals for public schools or recognized as vice principals for private schools must achieve a high level of professional standards for teachers of general education institutions; have the capacity to undertake the tasks assigned by the principal and satisfy the following requirements: must meet the standards trained by teachers according to the provisions of the Law on Education for primary school level; have taught for at least 5 years (or 4 years for mountainous, island, highland, deep-lying, remote areas, ethnic minority areas, areas with extremely difficult socio-economic conditions) at elementaryschool level. 

c) The term of office of vice principals of primary schools is 5 years. After each school year, the vice-principal is evaluated by the principal, officials and employees of the school and evaluated by competent authorities according to regulations.

d) Duties and powers of the Vice-Principal

Responsible for administering the work assigned by the principal; administering the school's operations when authorized by the principal.

Participate in activities with professional groups; self-study and self-improvement to improve professional and management capacity; attend training courses on politics, expertise and management skills; participate in teaching according to regulations on teaching time norms for vice principals.

Enjoy allowances and preferential policies for teachers according to regulations.

Thus, according to the above provisions in Vietnam, the principal shall work at a public elementary school for no more than two consecutive terms. So, if you are appointed principal of a public elementary school, you can serve as principal for a maximum of 2 terms.

How many members of the public elementary school council in Vietnam? 

In Clause 1, Article 10 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT, it stipulates on the School Council of public schools as follows:

1. School council of public schools

a) The School Council of a public school is the school administration organization, exercising the right to represent the ownership of the school and relevant interested parties, and is responsible for deciding on the direction of the school's activities, mobilizing and monitoring the use of resources for the school, linking the school with the community and society, and ensuring the achievement of educational goals.

b) The composition of the public school council includes: party committee secretary; principal; Union president; Secretary of the Ho Chi Minh Communist Youth Union; representatives of professional groups, office groups; representatives of local authorities and representatives of students' parents.

The school council has a president, vice president, secretary and other members.

The minimum number of members of the school council is 07 people and the maximum is 11 people.

c) Duties and powers of the public school council: decide on the school's strategy, vision, plan, and development goals in each period and each school year; decide on the regulations or amend and supplement the regulations on organization and operation of the school to submit to the competent authorities for approval; decide on the policy of using the school's finances and assets; supervise the activities of the school; supervise the implementation of the school council's resolutions, the implementation of democratic regulations in the school's activities.

d) Activities of the public elementary school council

The school council meets regularly at least three times a year. In necessary cases, at the request of the principal or at least one-third of the school council members, the school council president has the right to convene an extraordinary meeting to resolve issues arising in the course of implementation on duties and powers of the school. The school council president may invite representatives of local authorities and organizations to attend school council meetings when necessary.

A school council meeting is considered valid when three-quarters of the council's members are present (including the council president). A resolution of the school council is adopted and takes effect when it is unanimously approved by at least two-thirds of the members present. The school council's decisions are made public.

The school principal is responsible for implementing the resolutions or conclusions of the school council on the contents specified at point c, clause 1 of this Article. If the principal disagrees with the resolution of the school council, he/she must promptly report it and seek the advice of the school's immediate superior education management agency. While waiting for the opinion of the competent authority, the principal must still comply with the resolution of the school council on issues that are not contrary to current law and this Charter.

e) Procedures for setting up a public elementary school council

Pursuant to the regulations on the composition of the school council in Section b, Clause 1, Article 10 of this Circular, the principal compiles a list of personnel introduced by the teachers' collective and the school's organizations and unions, submit to the President of the People's Committee of the district to issue a decision on the establishment of the school council. The president of the school council is a member of the school and is elected by the members of the school council; The vice-president and secretary of the council shall be appointed by the chairman of the council. The term of office of the school council is 5 years, in case of any change in personnel, the principal shall make a written request to the competent authority to issue a decision to supplement and strengthen the school council.

According to this Article in Vietnam, the school council of the elementary school has from 7 to 11 members, including the principal; Union president; Secretary of the Ho Chi Minh Communist Youth Union; representatives of professional groups, office groups; representatives of local authorities and representatives of students' parents.
