What Happens to Teachers Who Insult Students?
According to Article 16 of Decree 112/2020/ND-CP on the application of disciplinary measures of reprimand against public employees
The disciplinary measure of reprimand is applied for first-time violations that cause less serious consequences, excluding violations specified in Clause 3, Article 17 of this Decree, in one of the following cases:
...
- Abusing one's position for personal gain; displaying an authoritarian attitude, or causing difficulties and inconvenience to the public during the execution of assigned tasks and duties; certifying or issuing legal documents to individuals who do not meet the qualifications; insulting the honor, dignity, and reputation of others during professional activities.
Thus, a teacher at a public school (public employee) who insults the honor and dignity of a student can be reprimanded. Additionally, the school will consider issuing the most appropriate disciplinary measures for your case, so you should inform the school of this incident.
Furthermore, Point b, Clause 1 and Point b, Clause 3 of Article 28 of Decree 04/2021/ND-CP stipulates regulations on violations of student discipline; insulting the honor and dignity, infringing on the physical body of students; violating regulations on policies towards students
- Fines ranging from VND 5,000,000 to VND 10,000,000 for any of the following acts: Insulting the honor and dignity, infringing on the physical body of students, but not to the extent of criminal prosecution.
- Remedial measures: Public apology to the offended party for insulting their honor and dignity; infringing on their physical body for violations specified in point b, clause 1 of this Article, except in cases where the offended party or the lawful representative of a minor does not request a public apology.
