Student Assaulting Teacher: Is a One-Year Expulsion Imposed?
Section III.5 Circular 08/TT of 1988 Regulations:
Expulsion for 1 Year:
Students who commit any of the following violations will be subject to disciplinary action by the school's Disciplinary Council, which will recommend the Principal to enforce a disciplinary measure of one-year expulsion. This will be recorded in the student's academic record and notified to the family, while also entrusting the family, youth organizations, and local authorities to continue the education:
- Committed a violation that led to a one-week expulsion sanctioned by the school's Disciplinary Council through the Principal but refused to correct the behavior, continued to reoffend, or committed additional violations;
- Committed a very serious violation, even if it was the first time, but the act was conscious and deliberate (not due to coercion or following others), causing extremely significant and dangerous harm to social property and human life such as: participating in theft, robbery, debauchery, reactionary activities, etc., using weapons (daggers, bayonets, pistols, grenades, etc.) to engage in organized fighting, injuring others, committing crimes outside the school that led to police arrest, or other violations of similar nature and severity...
Thus, if a student assaults a teacher and meets the above conditions, they may be expelled for one year.
