Recovery of Allowance for Chief Team Leader: Is It Correct?
Based on Section 1.1 of the Joint Circular 23/TTLN of 1996, stipulating allowances for teachers serving as Team Leaders (Bartenders) specifically as follows:
Teachers appointed as Team Leaders (including both full-time and part-time staff) in general education schools are entitled to the following policies:
* Responsibility allowance according to the coefficient with the following levels:
- Teachers who are Team Leaders in first-class schools are entitled to a responsibility allowance coefficient of 0.30 of the minimum salary.
- Teachers who are Team Leaders in second-class schools are entitled to a responsibility allowance coefficient of 0.20 of the minimum salary.
- Teachers who are Team Leaders in third-class schools are entitled to a responsibility allowance coefficient of 0.10 of the minimum salary.
When the teacher ceases to be a Team Leader, this allowance will no longer be provided.
The classification of schools for calculating responsibility allowances for the position of teacher - Team Leader is based on Section I of Circular No. 10/GD-DT dated July 29, 1994, of the Ministry of Education and Training.
* Salary classification for teachers and entitlement to allowances and other policies similar to those for teachers (leave, summer vacation, professional development training, office supplies, etc.).
* Entitlement to reward policies similar to those for teachers and other titles, as agreed between the Central Committee of the Ho Chi Minh Communist Youth Union and the Ministry of Education and Training.
- Excellent Team Leaders at various levels, on a par with excellent teachers at the same level, are considered for teaching medals, the “For the Young Generation” medal, and other medals of the Ho Chi Minh Communist Youth Union.
In addition to the above regulations, depending on the specific conditions of each locality, other policies may be considered to facilitate the activities of Team Leader teachers, such as organizing annual study tours and exchanging advanced experiences, providing material conditions for activities, etc.
Thus, if your payment of responsibility allowance as well as salary is incorrect according to the above regulation, the agency will recover the illegally paid amount.
If you receive allowances and other policies according to the appropriate regulations, the agency's recovery of allowances and other policies is against legal regulations.
