b) The composition of the public school council includes: Party secretary; Principal; Chairman of the Trade Union; Secretary of the Ho Chi Minh Communist Youth Union; Representative of the professional team, office team; Representative of the local government and the Parent-Teacher Association.
The school council has a chairman, vice chairman, secretary, and other members.
The number of members of the school council is at least 7 and a maximum of 11.
Therefore, according to the above regulations, the Parent-Teacher Association of a public primary school is a member of the school council.

When is a meeting of the school council of a public primary school in Vietnam recognized as valid?
According to Point d, Clause 1, Article 10 of the Charter of Primary Schools issued together with Circular 28/2020/TT-BGDĐT, the activities of the public primary school council are regulated as follows:
The board of directors meets regularly at least three times a year. In necessary cases, when the principal or at least one-third of the board members propose, the chairman of the board of directors has the right to convene an extraordinary meeting to resolve issues arising in the course of carrying out the duties and powers of the school. The chairman of the board of directors may invite representatives of the local government and organizations to attend the board meeting if necessary.
The council meeting is recognized as valid when there are more than three-quarters of the board members present (including the chairman of the board). The board's resolution is passed and becomes effective when at least two-thirds of the members present agree. The board's resolution is published publicly.
The principal of the school is responsible for implementing the resolutions or conclusions of the board of directors on the contents specified in Clause c, Clause 1 of this Article. If the principal does not agree with the resolution of the board of directors, he/she must promptly report and seek the opinion of the directly superior educational management agency of the school. During the waiting period for the opinion of the competent authority, the principal must still implement the resolution of the board of directors for issues that do not violate current laws and this Charter.
Therefore, the public primary school council meeting is recognized as valid when there are more than three-quarters of the members present and the chairman of the council must be present.

According to Point e, Clause 1, Article 10 of the Charter of Primary Schools issued together with Circular 28/2020/TT-BGDĐT, the procedures for establishing a public primary school council are as follows:
Based on the provisions on the composition of the board of directors at point b, clause 1, Article 10 of this Circular, the principal summarizes the list of personnel introduced by the faculty and organizations and associations of the school, and proposes to the chairman of the People's Committee of the district to issue a decision to establish the board of directors. The chairman of the board of directors is a member of the school and is elected by the members of the board; the vice chairman and secretary of the board are appointed by the chairman of the board. The term of office of the board of directors is 5 years. In the event of a change in personnel, the principal makes a written proposal to the competent authority to issue a decision to supplement or complete the board of directors.
Therefore, according to the above regulations, the term of office of the public primary school council is 5 years.
