How long does it take for a vice principal of a secondary school to have their disciplinary action expunged?
Based on the provisions of Clause 4, Article 37 of Decree 112/2020/ND-CP:
A disciplinary decision against a public employee is effective for 12 months from the effective date of enforcement. During this period, if the public employee does not continue to engage in legal violations to the extent that disciplinary action is required, the disciplinary decision will automatically terminate without the need for a document confirming the termination of its effect.
Thus, according to this regulation, the disciplinary clearance period for you is from October 25, 2020, to October 25, 2021.
If during this period you do not violate any disciplinary rules, your disciplinary record will automatically be cleared.
Additionally, according to Clause 3, Article 11 of the Charter for secondary schools, high schools, and multi-level schools issued in conjunction with Circular 32/2020/TT-BGDDT, the Vice Principal of a secondary school must meet the following standards:
- Regarding education level and working experience: must meet the standard education level of a teacher as stipulated by the Education Law for the respective educational level, achieve the highest standard education level for multi-level schools, and have at least 5 years (or 4 years for remote, island, highland, deep-lying, ethnic minority areas, or areas with especially difficult socio-economic conditions) of teaching experience at that educational level.
- The principal and vice principal of a secondary school must meet the standards stipulated in the standards for principals of secondary schools, high schools, and multi-level schools according to the principal standards for educational institutions in Circular 14/2018/TT-BGDDT.
According to the above regulations, the standards for appointing the position of Vice Principal do not mention disciplinary actions during the tenure. Therefore, by the year 2021, when you undergo the reappointment process for the position of Vice Principal, if you still meet the conditions as prescribed, you will be reappointed and not affected by the disciplinary decision from 2020.
