How Does the College Board of Trustees Operate?
According to Clause 3, Article 11 of Circular 15/2021/TT-BLDTBXH (Effective from December 15, 2021) stipulating the activities of the college board of trustees as follows:
a) The board of trustees shall meet regularly at least once every 03 (three) months and convene extraordinary meetings upon written request of more than 30% of the total members of the board of trustees or upon written request of the principal or the chairman of the board of trustees.
A meeting of the board of trustees is considered valid when at least 70% of the total members of the board of trustees are present. The board of trustees operates on the principle of collective governance, making decisions by majority vote. A resolution of the board of trustees is valid when more than 50% of the total members of the board agree. In the event of a tie, the final decision shall be made in favor of the chairman of the board of trustees. All meetings of the board of trustees must be recorded in minutes. The minutes and resolutions of the board of trustees must be sent to all members of the board of trustees and the supervisory authority of the college no later than 10 working days from the date the meeting is held or the resolution is signed.
b) The term of the board of trustees complies with the provisions of Clause 5, Article 11 of the Law on Vocational Education. The board of trustees is authorized to use the seal and organizational structure of the college to carry out tasks within the scope of its functions, responsibilities, and powers.
c) Delegation of executive power of the board of trustees
When the chairman of the board of trustees cannot perform his duties within the timeframe stipulated by the organizational and operational regulations of the college, he/she is responsible for delegating in writing one of the remaining members of the board to assume the responsibilities of the chairman. The written delegation must be notified to all members of the board of trustees, sent to the supervisory authority of the college, and publicly announced within the college. The delegation period shall not exceed 06 (six) months.
