According to Article 7 of Decree 125/2024/ND-CP regulating the suspension of educational operations of kindergartens:
Article 7. Suspension of educational operations of kindergartens
1. A kindergarten's educational operations are suspended in the following cases:
a) Engaging in fraudulent activities to obtain permission for educational operations;
b) The person granting permission for educational operations is not authorized;
c) Failing to implement educational operations within 1 year from the date of being permitted to operate educational activities;
d) Violating legal regulations on education and being subjected to administrative penalties to the extent of requiring suspension of educational operations;
dd) Other cases as prescribed by law.
2. The Head of the Department of Education and Training shall decide on the suspension of educational operations for kindergartens.

What are the conditions for educational operations of kindergartens in Vietnam?
According to Article 5 of Decree 125/2024/ND-CP regulating the conditions for educational operations of kindergartens in Vietnam:
Article 5. Conditions for educational operations of kindergartens in Vietnam
1. Having land, facilities, equipment, tools, and toys that meet the standards on location, scale, area, and minimum facilities for kindergartens as prescribed by the Ministry of Education and Training.
For the central areas of special-grade urban cities, the school construction land area can be replaced with the building floor area and must ensure that the building floor area is not less than the minimum average land area per child as prescribed.
2. Having an educational program, materials, and learning materials that meet the requirements of the preschool education program as prescribed by the Ministry of Education and Training.
3. Having a team of management staff, teachers, employees, and workers that ensure the quantity and meet the standards to organize activities for nurturing, caring, and educating children according to the requirements of the preschool education program as prescribed by the Ministry of Education and Training.

Thus, the conditions for educational operations of kindergartens in Vietnam include:
- Having land, facilities, equipment, tools, and toys that meet the standards on location, scale, area, and minimum facilities for kindergartens as prescribed by the Ministry of Education and Training.
- For the central areas of special-grade urban cities, the school construction land area can be replaced with the building floor area and must ensure that the building floor area is not less than the minimum average land area per child as prescribed.
- Having an educational program, materials, and learning materials that meet the requirements of the preschool education program as prescribed by the Ministry of Education and Training.
- Having a team of management staff, teachers, employees, and workers that ensure the quantity and meet the standards to organize activities for nurturing, caring, and educating children according to the requirements of the preschool education program as prescribed by the Ministry of Education and Training.
- Having sufficient financial resources to ensure the maintenance and development of educational activities:
+ For private kindergartens, the minimum investment is 30 million VND/child (excluding land use costs). The total minimum investment is calculated According to the expected maximum scale at any given time. The investment capital plan must be appropriate for the projected scale of each phase.
For cases where private kindergartens do not build new facilities but only rent or use existing facilities to carry out nurturing, caring, and educating activities for children, the minimum investment must reach 70% of the investment level specified in point a of this clause;
+ For public and community kindergartens, financial resources are assured by authorized management agencies or the local community to meet the requirements of the preschool education program as prescribed.
What requirements must the programmes of preschool education meet?
According to Article 25 of the Education Law 2019 stipulating that the preschool education program must meet the following requirements:
- Reflect the goals of preschool education
- Specify the requirements to be achieved at each age, educational activities, methods, forms of organizing educational activities, educational environment, and evaluation of child development
- Be consistent nationwide and implemented flexibly, appropriate to the specific conditions of localities and preschool educational institutions.
