Having an Accident While Studying at University: Can You Take a Leave to Recuperate?
In Point c, Clause 1, Article 15 of the University-Level Education Training Regulations, promulgated together with Circular 08/2021/TT-BGDDT, there are provisions on temporary leave, withdrawal from studies as follows:
Article 15. Temporary Leave, Withdrawal from Studies
- Students may apply for temporary leave and retain their academic results in the following cases:
a) Mobilized into the armed forces;
b) Mobilized by a competent authority or representing the country in international competitions and tournaments;
c) Illness, maternity, or accidents requiring long-term treatment with certification from a competent health examination and treatment facility as prescribed by the Ministry of Health;
d) Other personal reasons, but must have studied for at least one semester at the training institution and not be subject to consideration for expulsion or disciplinary review.
Thus, in the event you have an accident, you are entitled to apply for temporary leave and retain your academic results.
Does the Recovery Period Due to an Accident Count Towards the Official Study Period?
In Clause 2, Article 15 of the University-Level Education Training Regulations, promulgated together with Circular 08/2021/TT-BGDDT, there are provisions as follows:
Article 15. Temporary Leave, Withdrawal from Studies
- The period of temporary leave for personal reasons must be counted towards the official study period specified in Clause 5, Article 2 of this Regulation.
In Clause 5, Article 2 of the University-Level Education Training Regulations, promulgated together with Circular 08/2021/TT-BGDDT, there are provisions as follows:
Article 2. Training Program and Study Duration
- The maximum time for a student to complete the course is stipulated by the training institution's regulations but must not exceed twice the scheduled study time for the entire course for each form of training. For students in articulation programs who have been exempted from accumulated credit units, the maximum time to complete the course is determined based on the scheduled study time reduced corresponding to the exempted credit units.
Thus, the recovery period due to an accident is counted towards the official study period.
