Has the Circular 29/2024/TT-BGDDT on the regulations on extra classes in Vietnam been issued yet? 

On December 30, 2024, the Minister of Education and Training of Vietnam issued Circular 29/2024/TT-BGDDT regulating extra classes for general education and continuing education, including: principles of extra classes and extra tutoring; cases where extra classes are prohibited; organization of extra classes and tutoring; responsibilities for managing extra classes and tutoring activities.

Circular 29/2024/TT-BGDDT applies to tutors, students taking extra classes; organizations and individuals organizing extra classes and tutoring and relevant organizations and individuals.

Circular 29/2024/TT-BGDDT takes effect from February 14, 2025.

Which cases are prohibited from organizing extra classes and tutoring?

According to Article 4 of Circular 29/2024/TT-BGDDT, the cases where organizing extra classes and tutoring is prohibited are specified:

Article 4. Cases where extra classes and tutoring are prohibited

  1. Extra classes for primary school students are not organized, except for cases: training in arts, sports, and life skills.
  1. Teachers teaching at schools are not allowed to tutor outside of school for students whom they are assigned to teach according to the school’s educational plan and receiving payment from those students.

The cases where extra classes and tutoring are prohibited include:

- Extra classes are not organized for primary school students, except for cases: training in arts, sports, and life skills.

- Teachers teaching at schools are not allowed to tutor outside of school for students whom they are assigned to teach according to the school’s educational plan and receiving payment from those students.

- Teachers from public schools are not allowed to manage or administer extra classes outside of school, but they can participate in tutoring outside of school.

What are rights of primary school teachers in Vietnam when performing the duties of a homeroom teacher?

According to Clause 2, Article 29 of the Primary School Charter issued with Circular 28/2020/TT-BGDDT, the rights of teachers and staff are specified as follows:

Article 29. Rights of teachers and staff

  1. Teachers performing the duties of a homeroom teacher, besides the rights stated in clause 1 of this Article, have the following rights:

a) To attend the lessons, other educational activities of the students in their homeroom class.

b) To attend meetings of the commendation and reward council and other councils when resolving issues related to the students of their homeroom class.

c) To participate in professional development courses and thematic conferences on homeroom work.

d) To grant permission for individual students to be absent for not more than 03 consecutive days.

đ) To have reduced weekly teaching hours and other rights as prescribed.

Thus, primary school teachers performing the duties of a homeroom teacher have the following rights:

- To receive salary, allowances, subsidies, incentives, and other policies as prescribed; to be reclassified in professional titles; to have their dignity, honor, and health protected, and to enjoy material and spiritual rights as prescribed.

- To autonomously carry out professional tasks with the support of the professional group and the school in selecting and adjusting educational content; applying forms of activities and educational methods, and evaluating students suitable for specific student groups and the school’s conditions.

- To be facilitated in learning to enhance their qualifications, professional development, and expertise; to enjoy salary, salary-related allowances, and other policies as prescribed when authorized by a competent authority for further study and training.

- To be rewarded and recognized with emulation titles and other prestigious titles as prescribed.

- To exercise other rights as prescribed by law.

- To attend the lessons and other educational activities of students in their homeroom class.

- To attend meetings of the commendation and reward council and other councils when resolving issues related to the students of their homeroom class.

- To participate in professional development courses and thematic conferences on homeroom work.

- To grant permission for individual students to be absent for not more than 03 consecutive days.

- To have reduced weekly teaching hours and other rights as prescribed.
