Based on Clause 1 of Article 28 of the 2019 Education Law, the regulations on educational levels and entry ages are as follows:

1. Educational levels and age groups of general education are regulated as follows:

a) Primary education lasts for 05 school years, from the first to the fifth grade. The entry age for the first grade is 06;

b) Lower secondary education lasts for 04 school years, from the sixth to the ninth grade. Students must complete the primary educational programme before entering the sixth grade. The entry age for the sixth grade is 11;

c) Upper secondary education lasts for 03 school years, from the tenth to the twelfth grade. Students must complete the lower secondary educational programme before entering the tenth grade. The entry age for the tenth grade is 15;

In Clause 2 of Article 28 of the 2019 Education Law, regulations on cases where schooling could be commenced at younger ages or at higher ages prescribed in clause 1 of this Article are as follows:

a) Commencing schooling at younger ages for students with early intellectual development;

b) Commencing schooling at older ages for students repeating classes, students living in areas with exceptional socio-economic difficulties, students belonging to ethnic minorities, disabled and handicapped students, students with physical or intellectual disadvantages, orphan students, students of poor households, students returning from overseas and other cases as prescribed by law.

Therefore, this year you are 16 years old and have returned from abroad, so you can still go back to study in grade 9 because the law allows students to study at an age older than the prescribed age as mentioned above. You can contact the Lower secondary school you want to attend for specific guidance on the enrollment procedures according to the regulations in Vietnam.

What are regulations on dossiers and procedures for re-study application in Vietnam?

According to Article 6 of Decision 51/2002/QD-BGDDT, dossiers and procedures for re-study application are regulated as follows:

1. Dossiers of re-study application

a/ The re-study application, signed by the pupil concerned.

b/ The study result register of the grade or educational level already completed (the original).

c/ The diploma of the lower educational level (a notarized copy).

d/ The written certification by the administration of the pupils' residence place of his/her observance of the State's policies and laws.

2. Re-study application procedures.

a/ Cases of application for re-study at former schools:

The principals of the schools shall permit the pupils to study at their schools after checking their dossiers.

b/ Cases of application for re-study at other schools:

The dossiers shall be supplemented and procedures be carried out as for pupils changing schools.

c/ Cases of application for re-study at the first grade of the senior secondary education level:

The directors of provincial-level Education and Training Services shall consider and make decisions on the basis of the entrance examination or enrollment consideration results of the pupils before they drop out.

3. The re-study application shall be effected during the summer vocation time before the start of the new school year.
