Can intermediate schools establish enterprises in Vietnam?
The intermediate school where I work wants to set up an enterprise affiliated to the school and self-funded. May I ask, according to the latest regulations of the law in Vietnam, will my school be allowed to set up an enterprise like this?
Can intermediate schools establish enterprises in Vietnam?
Pursuant to Clause 2, Article 25 of Circular 14/2021/TT-BLDTBXH, there are regulations on science and technology organizations; practice facilities, training service and scientific research organizations; facilities of productions, businesses, and services as follows:
1. Intermediate schools may establish affiliated organizations to serve the training activities namely: Library; scientific research centers; centers for the application of technique and technology; centers for cooperation with enterprises; workshops; tradition preservation room; clubs; houses of culture and sports; dormitories and cafeterias.
2. Intermediate schools may establish enterprises, practice facilities, facilities of productions, businesses, and services to facilitate the enhancement of knowledge and professional skills of students and teachers. All of the mentioned activities shall comply with the regulations of the law.
3. Organizations prescribed in Clauses 1, 2 of this Article shall not issue certificates, diplomas
4. The establishments, dissolutions, functions, duties, organizational structures, and operations of the organizations prescribed in Clauses 1, 2 of this Article shall be decided by the principal according to the resolutions of the school council (if it is a public intermediate school), or the board of directors (if it is a private intermediate school), provisions of the related law, and specified in the regulations of the organization and operation of the school.
Thus, according to the regulations on the intermediate school where you work, you have the right to establish an enterprise. However, enterprises established by intermediate schools must aim to create conditions for learners and teachers of the school to practice knowledge and professional skills in Vietnam.
