Asking Someone to Take an Exam for You: Will You Be Suspended? Can You Reapply Like Other Students After Disciplinary Action?
Can You Be Suspended from School for Having Someone Take an Exam on Your Behalf?
Based on Article 20 of the Regulation on University Education stipulated in Circular 08/2021/TT-BGDDT regarding the handling of student violations as follows:
Students who cheat during exams, tests, or assessments of learning outcomes will be disciplined for each subject in which the violation occurred according to the current regulations of the National High School Graduation Examination issued by the Ministry of Education and Training, except as stipulated in Clause 2 of this Article.
Students who take exams for others or let others take exams for them will be disciplined by a one-year suspension for the first violation and expulsion for the second violation.
Students who use fake documents, degrees, or certificates as conditions for admission or graduation will be expelled; degrees already issued will be revoked and annulled.
Thus, under current regulations, having someone take an exam on your behalf will result in a one-year suspension for the first violation and may lead to expulsion for the second violation.
Can Suspended or Disciplined Students Re-apply for Admission Like Other Students?
According to Article 15 of the same Regulation, which also stipulates temporary leave and discontinuation of studies as follows:
- Students are allowed to temporarily leave and retain the results of their studies in the following cases:
a) Being mobilized into the armed forces;
b) Being appointed by a competent authority, representing the nation in international competitions or tournaments;
c) Being ill, pregnant, or having accidents requiring long-term treatment as certified by an authorized medical facility as regulated by the Ministry of Health;
d) For other personal reasons but must have completed at least one semester at the training institution and not fall within cases of being considered for expulsion or disciplinary action.
The period of temporary leave for personal reasons must be counted towards the official study time stipulated in Clause 5, Article 2 of this Regulation.
Students who voluntarily discontinue their studies for personal reasons, except those considered for expulsion or disciplinary action, must re-apply for admission like other candidates if they wish to return.
The regulations of the training institution shall specify conditions, authority, procedures for granting temporary leave, re-admission, and discontinuation; and the retention and recognition of accumulated learning outcomes for students who discontinue their studies.
Suspension does not fall under the cases allowed to re-apply for admission like other candidates.
