Are teachers entitled to receive both attraction allowances and long-term allowances concurrently?
According to Clause 1, Article 2 of Decree 76/2019/ND-CP, the regulations are as follows:
officials and public employees, employees in agencies, organizations, units of the Communist Party, the State, socio-political organizations from the central level to the communes, wards, commune-level towns (hereinafter generically referred to as the commune level) and those receiving salaries in the armed forces (including cases of transfer, secondment, rotation, and regardless of whether they are local people or come from elsewhere) who have been classified according to the salary scale prescribed by the competent authorities of the Communist Party and the State, currently working or assigned to work in areas with extremely difficult socio-economic conditions, including:
officials and public employees (including probationers) in agencies, organizations, and public service providers of the Communist Party, the State, socio-political organizations from the central level to the commune level;
Additionally, Articles 4 and 5 of this Decree specify:
- Attraction Allowance: The subjects specified in Article 2 of this Decree are entitled to an attraction allowance amounting to 70% of the current salary level (according to the salary scale prescribed by the competent authorities of the Communist Party and the State) plus the position allowance, and the seniority allowance beyond the framework (if any) applicable to the actual working period in areas with extremely difficult socio-economic conditions for no more than 5 years (60 months).
- Long-term Service Allowance in Areas with Extremely Difficult Socio-Economic Conditions: The subjects specified in Article 2 of this Decree are entitled to a monthly allowance calculated based on the statutory pay rate and the actual working period in areas with extremely difficult socio-economic conditions.
Thus, since you are a public employee teaching at a public school in a commune with extremely difficult socio-economic conditions, you may simultaneously enjoy both the attraction allowance and the long-term service allowance.
In principle, you can only enjoy the highest level of the same type of policy as stipulated in different documents; therefore, you are still entitled to both different policies simultaneously (Clause 1, Article 3 of this Decree).
