Are preschool teachers on summer vacation entitled to allowances and subsidies in Vietnam?

Pursuant to Article 3 of Circular 48/2011/TT-BGDĐT stipulating the working time and annual leave of teachers as follows:

1. The working time in a year of a preschool teacher is 42 weeks, in which:

a) 35 weeks of child rearing, care and education (hereinafter referred to as teaching children);

b) 04 weeks for study and professional training;

c) 02 weeks for the preparation of the new school year;

d) 01 week for summarizing the school year.

2. The annual leave time of preschool teachers includes: summer vacation and other holidays, specifically as follows:

a) The teacher's summer vacation period is 08 weeks, with full salary and allowances and subsidies (if any);

b) Other days off shall comply with the provisions of the Labor Code and current regulations.

Based on the school year plan, size, characteristics and specific conditions of each school, the Principal shall arrange the annual leave time for teachers in a reasonable manner in accordance with regulations.

Thus, preschool teachers during summer vacation in Vietnam as prescribed are still entitled to their full salary and allowances and subsidies (if any).

How many teaching hours for preschool teachers teaching group of children to study 2 sessions a day in Vietnam?

According to Article 4 of Circular 48/2011/TT-BGDĐT, teaching hours are as follows:

1. For teachers who teach groups of children, the kindergarten class has 2 lessons per day, each teacher teaches in the class for 6 hours a day and performs preparatory work for class time as well as other jobs prescribed by the Principal to convert to a guarantee of working 40 hours/week.

2. For teachers who teach groups of children, the kindergarten class has one session per day, each teacher teaches in the class for four hours a day and performs preparatory work for class time as well as other jobs prescribed by the Principal to convert to working 40 hours/week.

3. For teachers who teach classes with children with disabilities learning integration, each teacher must teach for the full number of hours specified in Clause 1 or Clause 2 of this Article; in which, for every 01 disabled child/class, each teacher is charged an additional 0.5 teaching hours/day.

4. For principals and deputy principals, in addition to performing the duties of principals and vice principals as prescribed in the preschool charter, the principal must directly participate in educational activities (teaching children or attend the teacher's teaching time in the school) 02 hours a week; Vice-principals must directly participate in educational activities for 4 hours a week.

According to this Article, pre-school teachers who teach groups of children to study 2 sessions/day must have 6 hours of classroom teaching time/day and perform preparatory work for class time as well as other tasks prescribed by the principal to convert to working 40 hours/week in Vietnam.

How many teaching hours per week can preschool teachers who are union presidents be reduced in Vietnam? 

In Article 5 of Circular 48/2011/TT-BGDĐT stipulating regime of reducing the norm of teaching hours and teaching hours as follows:

1. Kindergarten teacher

a) Teachers who are presidents and vice presidents of grassroots trade unions who are part-time are entitled to a reduction of 06 teaching hours in a week (which translates into 210 teaching hours in a school year);

b) The teacher serves as a member of the trade union executive committee; Part-time trade union leaders and vice-leaders are entitled to a reduction of 03 teaching hours per week (equivalent to 105 teaching hours in a school year).

2. Teachers of primary schools, junior high schools, senior high schools, high schools with many levels of education, specialized schools, vocational education centers - continuing education, continuing education centers provincial level

a) Teachers who are presidents and vice presidents of grassroots trade unions who are not part-time at primary schools or specialized primary schools are entitled to a reduction of 04 teaching hours in a week (equivalent to 140 teaching hours in a school year); Lower secondary school, junior high school, upper secondary school, upper secondary school, vocational education center - continuing education, provincial continuing education center reduction of 03 teaching hours in a week (reducing 105 teaching hours in a school year);

b) Teachers who work as members of the executive committee of the trade union, the leader and vice-leader of the trade union in part-time at primary schools and specialized elementary schools are entitled to a reduction of 02 teaching hours in a week (which translates to 70 teaching hours in a year); Lower secondary school, junior high school, upper secondary school, upper secondary school, vocational education center - continuing education, provincial continuing education center reduced by 01 teaching hour in a week (reducing 35 teaching hours in a school year);

c) For general schools with many levels of education, the norm of reduction of teaching hours for teachers doing part-time trade union work shall be calculated according to the highest norm of reduction of teaching hours prescribed for each educational level.

3. Middle School Teacher

a) Teachers who are part-time trade union presidents and vice presidents of grassroots trade unions are entitled to a reduction of 76 teaching hours in a school year;

b) Teachers who are part-time members of the executive committee, group leader and vice-leader of a trade union are not entitled to a reduction of 38 teaching hours in a school year.

4. Lecturer in colleges, institutes, universities and universities

For higher education institutions, every year, the Rector (Director) together with the Trade Union Executive Committee agree on a plan to determine the time used for trade union work for lecturers doing trade union work. part-timer to ensure compliance with the lecturer's duties (teaching, scientific research and other jobs) and regulations on the autonomy of the unit. If you choose to reduce your scientific research hours or do other jobs, you must comply with the provisions of Clause 2, Article 24 of the Trade Union Law. If the option to reduce the teaching hours is selected, the following regulations shall apply:

a) Lecturers who are part-time presidents and vice presidents of grassroots trade unions are entitled to a reduction of 44 teaching hours in a school year;

b) Lecturers who work as members of the executive committee, group leaders and vice-leaders of trade union groups are not entitled to a reduction of 22 teaching hours in a school year.

Thus, preschool teachers who are part-time presidents of grassroots trade unions are entitled to a reduction of 06 teaching hours in a week in Vietnam (which translates to 210 teaching hours in a school year).
