According to the law in Vietnam, can teachers discipline students by punishment under the form of copying?

Pursuant to Clause 3 Article 38 of the Charter of Primary School issued together with the Circular 28/2020/TT-BGDĐT stipulating reward and discipline as follows:

Reward and discipline

1. Implement rewards and discipline for students according to the regulations of the Ministry of Education and Training.

3. Students who have shortcomings in the process of learning, training and competitive movements, depending on the level of violation, can implement the following disciplinary measures: reminding, directly supporting and helping students to improve; informing parents of students to coordinate in helping students to overcome shortcomings. Teachers are not allowed to criticize students in front of the whole class, in front of the whole school or in a meeting with parents.

Pursuant to Article 38 of the Charter of the lower secondary school, upper secondary school and multi-level school issued together with the Circular 32/2020/TT-BGDĐT stipulating reward and discipline as follows:

2. Students making a mistake during the learning and training process shall be corrected or disciplined in the following ways:

a) Give the student a reminder, directly support them in correcting their mistake.

b) Reprimand the student, inform the student’s parent(s) to have the parent(s) cooperate in supporting the student in correcting their mistake.

c) Suspend the student’s study at school for a definite period and take other correcting measures according to regulations from the Ministry of Education and Training.

Therefore, the current regulations do not have a disciplinary measure called "copying punishment." Therefore, teachers are not allowed to discipline students by punishment under the form of copying.

In cases where students violate the regulations during the learning process, the following disciplinary measures for students are applied:

- Reminding, directly supporting and helping students to improve

- Informing parents of students to coordinate in helping students to overcome shortcomings

Following disciplinary measures are applied to lower secondary and upper secondary students:

- Giving the student a reminder, directly support them in correcting their mistake

- Reprimanding the student, informing the student’s parent(s) to have the parent(s) cooperate in supporting the student in correcting their mistake

- Suspending the student’s study at school for a definite period and taking other correcting measures

What are duties of learners in Vietnam?

Pursuant to Article 82 of the Law on Education in 2019 stipulating duties of learners as follows:

- Perform learning and training tasks according to educational programmes and plans, code of conduct of educational institutions.

- Respect teachers, staff, and employees of the educational institution; unite and help each other in learning and training; implement the regulations, charters, and regulations of the educational institution; and comply with the provisions of the law.

- Participate in labour and social activities, environmental protection activities appropriate to their age group, health and ability.

- Preserve and protect properties of educational institutions.

- Contribute to the building, protection and development of the traditions of educational institutions.

What are rights of learners in Vietnam?

Pursuant to Article 83 of the Law on Education in 2019 stipulating rights of learners as follows:

- Receive education and training so as to develop comprehensively and realize their potentials to the fullest.

- Receive respect; equal opportunities in education and learning; to have their talents, gifts, creations and inventions developed; to receive full information concerning their own learning and training.

- Have the possibility of leaping grades, shortening programme duration, learning at an age higher than regulated, extending programme duration or repeating class, be enabled to learn educational programmes as prescribed by law.

- Learn in a safe and healthy educational environment.

- Be awarded degrees/diplomas or certificates after completing educational levels, training qualifications or completing educational programmes as prescribed by law.

- Participate in collective activities in educational institutions in accordance with the law.

- Use infrastructure, libraries, equipment and facilities assigned to learning, cultural, sporting, athletic activities at educational institutions.

- Submit, directly or through their legal representatives, to educational institutions measures for the improvement of educational institutions, to protect learners' rights and interests.

- Benefit from preferential State policies in recruitment into State agencies upon graduation with excellent records and good conduct.

- Elect representatives for school council as prescribed by law.
