Do teachers receive full salary for Tet holiday in Vietnam?
Pursuant to the provisions of Clause 1, Article 13 of the 2010 Law on Public Employees, regulations on public employees' rights to rest are as follows:
Rights of public employees to rest
1. To take annual leaves, holidays and leaves for personal reasons under the labor law. Public employees who do not use any or all of prescribed annual leave days due to work requirements are entitled to a sum of money for those days on which they work.
2. Public employees working in mountainous, border, island, deep-lying and remote areas and in other special cases may take leave days of 2 years at a time if they so wish. If wishing to take leave days of 3 years at a time, they shall obtain consent of the heads of their public non-business units.
3. For special non-business fields, public employees may take paid leaves as provided by law.

Pursuant to the provisions of Article 112 of the 2019 Labor Code, regulations on holidays and New Year are as follows:
Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
b) Lunar New Year Holidays: 05 days;
c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);
d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).
2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.
3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.
Thus, teachers will still receive full salary during the 5 days of the Lunar New Year holiday in Vietnam.
What days do public high school teachers' annual leave include in Vietnam?
Pursuant to the provisions of Article 5 regulating working regimes for high school teachers issued with Circular 28/2009/TT-BGDDT amended by Clause 4, Article 1 of Circular 15/2017/TT-BGDDT and supplemented by Clause 3, Article 1 of Circular 15/2017/TT-BGDDT regulating working time and annual leave as follows:
Working hours and annual leave
1. The working time of a primary school teacher during the school year is 42 weeks, of which:
a) 35 weeks for teaching and educational activities according to regulations on school year time planning.
b) 05 weeks for studying and training to improve qualifications.
c) 01 week for preparing for the new school year.
d) 01 week for summarizing the school year.
2. The working time of middle school and high school teachers during the school year is 42 weeks, of which:
a) 37 weeks for teaching and educational activities according to regulations on school year planning.
b) 03 weeks for studying and training to improve qualifications.
c) 01 week for preparing for the new school year.
d) 01 week for summarizing the school year.
2a. The working time of a university preparatory school teacher is 42 weeks, of which:
a) 28 weeks for teaching and educational activities according to regulations on school year plans;
b) 12 weeks for studying, improving qualifications, developing documents, scientific research and a number of other activities according to the school year plan;
c) 01 week for preparing for the new school year;
d) 01 week for summarizing the school year
3. Teachers' annual leave includes: summer vacation, lunar new year vacation, semester vacation and other holidays, specifically as follows:
a) The teacher's annual summer vacation is 02 months (including annual leave according to the provisions of the Labor Code), with full salary and allowances (if any).
b) Lunar New Year holidays and semester breaks according to regulations of the Minister of Education and Training;
c) Other days off according to the provisions of the Labor Code.
Based on the school year plan, scale, characteristics, and specific conditions of each school, the Principal arranges annual leave time for teachers in a reasonable manner according to regulations.
Thus, the annual leave period of public high school teachers in Vietnam includes the following days:
- Teachers' annual summer vacation period is 02 months (including annual leave according to the provisions of the 2019 Labor Code), entitled to full salary and allowances (if any).
- Lunar New Year holiday and semester break according to regulations of the Minister of Education and Training;
- Other days off according to the provisions of the Labor Code 2019.
Note: Based on the school year plan, size, characteristics, and specific conditions of each school, the Principal arranges annual leave time for teachers in a reasonable manner according to regulations.
