What Constitutes a Business That Is No Longer Operating at Its Registered Address?
Based on the provisions at Clause 2, Article 41 of Decree 01/2021/ND-CP:
“No longer conducting business at the registered address” is the legal status of an enterprise, whereby through the inspection and verification work of the tax authority and relevant units, the enterprise is not found at the registered address. Information about the enterprise no longer conducting business at the registered address is provided by the tax authority to the business registration authority. Changes, updates, timing of status transition, and conclusion of legal status are decided by the tax authority. The tax authority is responsible for providing and updating the legal status “No longer conducting business at the registered address” of the enterprise to the business registration authority through the taxpayer information system connected with the national business registration information system. The business registration authority shall record and update the legal status provided by the tax authority into the national business registration database.
