What are violations of regulations on issuance and use of marital status certificates and sanctions in Vietnam?

Pursuant to Article 40 of Decree 82/2020/ND-CP regulating the above content as follows:

Violations of regulations on issuance and use of certificates of marital status

1. Fine from 1,000,000 VND to 3,000,000 VND for acts of erasing, altering or falsifying the content of documents issued by competent agencies, organizations or persons to carry out procedures for issuance of certification marital status.

2. Fine from 3,000,000 VND to 5,000,000 VND for one of the following acts:

a) Using another person's documents to carry out procedures for issuance of a certificate of marital status;

b) Inaccurating assurance about marital status to carry out procedures for issuing a certificate of marital status;

c) Providing false information and documents to obtain a certificate of marital status;

d) Using the certificate of marital status for purposes other than the purpose stated in the certificate.

3. Additional penalties:

Confiscate exhibits that are papers and documents that have been erased or altered to falsify the content for violations specified in Clause 1 of this Article.

4. Remedial measures:

Recommend competent agencies, organizations, and persons to consider and handle the issued certificate of marital status due to violations specified in Clause 1, Points a, b, and c, Clause 2, Article This; Papers and documents are erased or altered to distort the content specified in Clause 1 of this Article.

What are violations of regulations on death registration and sanctions in Vietnam? 

Pursuant to Article 41 of Decree 82/2020/ND-CP stipulating the above content as follows:

Violations of regulations on death registration

1. Fine from 1,000,000 VND to 3,000,000 VND for acts of erasing, altering or falsifying the content of documents issued by competent agencies, organizations or persons to carry out death registration procedures.

2. Fine from 3,000,000 VND to 5,000,000 VND for one of the following acts:

a) Giving false witness to another person to register a death;

b) Providing false information and documents to register a death.

3. Fine from 10,000,000 VND to 20,000,000 VND for one of the following acts:

a) Carrying out death registration procedures for living people;

b) Failing to carry out death registration procedures for the deceased for personal gain;

c) Providing false information and documents when completing death registration procedures for profit.

4. Additional sanctions:

Confiscate exhibits that are papers and documents that have been erased or altered to falsify the content for violations specified in Clause 1 of this Article.

5. Remedial measures:

a) Recommend competent agencies, organizations, and people to consider and handle issued papers and documents due to violations specified in Clauses 1 and 2, Points a and c, Clause 3 This; Papers and documents are erased or altered to distort the content specified in Clause 1 of this Article;

b) Forced to return illegal profits obtained from committing violations specified in Points b and c, Clause 3 of this Article.

What are violations of regulations on guardianship registration and sanctions in Vietnam?

Pursuant to Article 42 of Decree 82/2020/ND-CP stipulating the above content as follows:

Violations of regulations on guardianship registration

1. Fine from 1,000,000 VND to 3,000,000 VND for acts of erasing, altering or falsifying the content of documents issued by competent agencies, organizations or persons to carry out guardianship registration procedures.

2. Fine from 3,000,000 VND to 5,000,000 VND for one of the following acts:

a) Using another person's documents to complete guardianship registration procedures;

b) Providing false information and documents about the guardianship registration content.

3. Fine from 5,000,000 VND to 7,000,000 VND for using fake personal documents to carry out guardianship registration procedures.

4. Additional sanctions:

Confiscate exhibits that are papers and documents that have been erased or altered to falsify the content for violations specified in Clause 1 of this Article.

5. Remedial measures:

Recommend competent agencies, organizations, and persons to consider and handle issued papers and documents due to violations specified in Clauses 1 and 2 of this Article; Papers and documents are erased or altered to distort the content specified in Clause 1 of this Article.
