Pursuant to Article 59 of the Decree 82/2020/NĐ-CP stipulating as follows:

1. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed for one of the following acts:

a) Being married but still marrying someone else; being unmarried but marrying someone who is clearly know is married or has a wife;

b) Being married but living together as husband and wife with another person;

c) Not married but living as husband and wife with someone you clearly know is married or married;

d) Marriage or living together as husband and wife between a person who was once an adoptive father or mother with an adopted child, father-in-law with daughter-in-law, mother-in-law with son-in-law, stepfather with the wife's stepchild, stepmother with the husband's stepchild ;

dd) Obstructing marriage, claiming property during marriage or hindering divorce.

2. A fine of VND 10,000,000 to VND 20,000,000 shall be imposed for one of the following acts:

a) Marriage or cohabitation as husband and wife between persons of the same blood line in the direct line or between persons who are related within three generations;

b) Marriage or cohabitation as husband and wife between adoptive parents and adopted children;

c) Coercion to marry or deception to marry; coercion to divorce or deception to divorce;

d) Taking advantage of marriage to travel abroad, enter the country, reside, obtain Vietnamese citizenship, foreign citizenship; enjoy state preferential regimes or to achieve other purposes other than for the purpose of building a family;

dd) Taking advantage of divorce to evade property obligations, violate population policies and laws or to achieve other purposes other than to terminate the marriage.

3. Remedial Measures:

Compel the return of illegal profits obtained by violating the provisions at points d and đ of clause 2 of this Article.

What are regulations on acts of violating regulations on adoption and penalties for those acts in Vietnam?

Pursuant to Article 60 of the Decree 82/2020/NĐ-CP stipulating as follows:

1. Fines from 1,000,000 to 3,000,000 VND for one of the following acts:

a) Making false declarations to register an adoption.

b) Discriminating between biological and adopted children.

c) Failing to fulfill the obligation to report on the development of a domestically adopted child.

d) Erasing, amending, or distorting the content of documents issued by competent authorities to process adoption registration.

2. Fines from 3,000,000 to 5,000,000 VND for one of the following acts:

a) Taking advantage of adoption to violate population laws.

b) Taking advantage of being adopted by a war invalid, revolutionary meritorious person, or ethnic minority person to enjoy state incentives.

3. Fines from 5,000,000 to 10,000,000 VND for one of the following acts:

a) Bribing, coercing, threatening, or engaging in other illegal acts to obtain the consent of a person with the authority to consent to an adoption.

b) Taking advantage of giving, receiving, or introducing children for adoption to profit, except as provided in point c of this clause.

c) Taking advantage of adoption to exploit the labor of an adopted child.

4. Additional penalties:

Confiscation of the items, documents that have been erased, amended, or distorted in content for the act of violating the provisions of point d of clause 1 of this Article.

5. Remedial measures:

a) Recommending that competent authorities review and handle documents and papers that have been issued due to violations of the provisions of points a and d of clause 1, point b of clause 2 of this Article; documents and papers that have been erased, amended, or distorted in content as stipulated in point d of clause 1 of this Article.

b) Requiring the return of any illegal profits obtained due to violations of the provisions of point b of clause 2, points b and c of clause 3 of this Article.

c) Requiring the payment of all costs for medical examinations, treatment, and other costs (if any) due to violations of the provisions of point c of clause 3 of this Article.
