II. REGISTRATION, RECOGNIION OF INDIVIDUALS, CONSULTING ORGANIZATIONS OF THE NETWORK OF CONSULTANTS SUPPORTING DIGITAL TRANSFORMATION OF ENTERPRISES

1. Application for registration to join the Consultant Network

Consulting individuals and organizations wishing to join the Network of Consultants prepare 01 set of registration documents, including:

1.1. For individual consultants

a) Application form to join the Network of Consultants (according to Interactive Electronic Form 1- 01TVV).

b) Curriculum vitae and competency profile of the consultant (within 06 months to the time of application submission): a description of detailed information about the individual, professional expertise, experience and skills according to the criteria mentioned in Clause 1, Section I (according to the Interactive Electronic Form - 02TVV).

c) Valid copies (within 06 months up to the time of application submission) of papers, documents, certificates, etc related to the declared information.

III. RIGHTS AND OBLIGATIONS OF INDIVIDUALS, CONSULTING ORGANIZATIONS OF THE NETWORK OF CONSULTANTS SUPPORTING DIGITAL TRANSFORMATION OF ENTERPRISES

Individuals and organizations participating in the Consultant Network have the following rights and obligations:

1. Benefits

a) To be given priority to participate in short-term training, refresher and training courses to improve professional qualifications, skills, and skills in the fields of IT consulting and digital transformation.

b) Priority is given to referrals to provide services to support businesses in digital transformation.

2. Obligations

a) Obligations and responsibilities as prescribed by current law on provision of consulting services, performance of consulting contracts and provisions in Article 27 of the Law on Support for Small and Medium Enterprises.

b) Every 6 months, update information on capacity, experience and consulting contracts done for enterprises on the web portal of consultant network, support and evaluate the transformation level. business number, signed with a digital signature to comply with the safety assurance conditions as prescribed.

c) Comply with the provisions of law in consulting, do not take profit when providing consultancy and do not advise enterprises to commit illegal acts.

What are conditions for the recognition of an individual consultant to support enterprises in digital transformation in Vietnam?

Pursuant to Clause 1 Section I of the Criteria and regulations on recognition of consulting individuals and organizations of the network of consultantssupporting digital transformation of enterprises issued together with the Decision 376/QD-BTTTT in 2023 stipulating conditions for the recognition of an individual consultant to support enterprises in digital transformation in Vietnam as follows:

I. CRITERIA FOR RECOGNITION OF INDIVIDUALS, CONSULTING ORGANIZATIONS OF THE NETWORK OF CONSULTANTS SUPPORTING DIGITAL TRANSFORMATION OF ENTERPRISES

1. For individual consultants

1.1. Individual consultants are Vietnamese citizens with good health and full civil act capacity; have a sense of responsibility and professional ethics; are not in a state of criminal prosecution or subject to administrative handling measures in the field of consulting practice and must simultaneously meet the following criteria:

a) Possess a university degree or higher or have a training certificate or practice certificate related to the field of information technology (IT), digital transformation.

b) Have at least 01 year of experience in one of the following positions: director of an enterprise with 10 or more employees; managers at enterprises or non-business units; staff working at organizations with functions to support digital transformation, projects to support digital transformation; IT consultants, independent digital transformation for enterprises.

c) Have performed or is performing at least 01 consulting contract in the field of IT or digital transformation for organizations and enterprises within 36 months from the time of registration to join the Business Support Consultant Network. digital transformation (hereinafter referred to as the Consultant Network).

d) Not on the list of individuals or consulting organizations that have taken out of the Consultant Network announced at the Web Portal of the network of consultants, supporting and evaluating the level of digital transformation of enterprises (https: //dbi.gov.vn), National portal to support small and medium enterprises (SMEs) (https://digital.business.gov.vn).

1.2. Consultants being foreign workers, in addition to fully meeting the criteria specified at Point 1.1 above, must also meet the provisions of the Labor Code on foreign workers working in Vietnam.

- Possess a university degree or higher or have a training certificate or practice certificate related to the field of information technology (IT), digital transformation.

- Have at least 01 year of experience in one of the following positions: director of an enterprise with 10 or more employees; managers at enterprises or non-business units; staff working at organizations with functions to support digital transformation, projects to support digital transformation; IT consultants, independent digital transformation for businesses.

- Have performed or are performing at least 01 consulting contract in the field of IT or digital transformation for organizations and enterprises within the period of 36 months up to the time of registration to join the Network of Consultants to assist enterprises in digital transformation in Vietnam.

- Not on the list of individuals or consulting organizations that are removed from the Consultant Network announced at the Consultant Network Portal, supporting and evaluating the level of business digital transformation (https:/ /dbi.gov.vn), National portal to support small and medium enterprises (SMEs) (https://digital.business.gov.vn).
