Title: In the near future, will enterprises be required to notify the seal sample?
Currently, according to Clause 2, Article 44 of the Law on Enterprises 2014:
Before using, enterprises have the obligation to notify the seal sample to the business registration agency for public posting on the National Business Registration Portal.
However, from January 1, 2021, the effective date of the Law on Enterprises 2020, this provision has been abolished.
Accordingly, Article 43 of the Law on Enterprises 2020 provides:
Seals include those made at seal-making establishments or electronic signatures as per legal provisions on electronic transactions.
Enterprises shall determine the type, quantity, form, and content of seals of enterprises, branches, representative offices, and other units of the enterprise.
The management and storage of seals shall be carried out according to the company's charter or regulations issued by the enterprise, branch, representative office, or other units of the enterprise. Enterprises shall use seals in transactions in accordance with the law.
Thus, in the future, enterprises will not be obliged to notify the seal sample to the business registration agency for public posting on the National Business Registration Portal as currently required.
