Rights of Vietnam Debt Trading One Member Limited Liability Company

According to Article 9 of Decree 129/2020/ND-CP (Effective from December 10, 2020) regarding the rights of DATC as follows:

DATC exercises the rights as stipulated in the Law on Enterprises, the Law on Management and Utilization of State Capital Invested in Production and Business Activities at Enterprises, the Charter on Organization and Operation of the Company, and the following rights:

- Creditors, asset owners, debtors, obligors of debt repayment, guarantors, and related agencies, organizations, and individuals are required to provide information and documents related to the debt, assets during the process in which DATC executes the receipt, purchase of debts, assets, and unfinished projects as designated by the competent authority in accordance with the law.

- Request debtors and those holding collateral assets of the debt to deliver the collateral assets along with full legal documents, records of the collateral assets to DATC for handling according to the agreement in the collateral contract or other documents and the regulations of the law on secured transactions.

- Be supported by the relevant state management agencies to complete the procedures, legal dossiers concerning the collateral assets for debt recovery. The sequence and procedure are carried out in accordance with the regulations of the law.

- Perform registration of secured transactions related to the collateral assets of the debt (including land use rights, assets attached to the land, and future assets attached to the land) that DATC has purchased, including the collateral assets of the purchased debt that have not yet been registered for secured transactions. The sequence and procedure are carried out in accordance with the regulations of the law on secured transaction registration.

- DATC becomes the security recipient and performs the registration of secured transactions based on the debt purchase contract without re-signing the security contract with the guarantor. The sequence and procedure are carried out in accordance with the regulations of the law on secured transactions.

- Inherit the rights and obligations of creditors, asset owners, and security recipients related to the purchased debts and assets as stipulated by law.
