Procedure for Registration of Change in Business Household Owner
Pursuant to the provisions of Clauses 3, 5, and 6, Article 90, Decree 01/2021/ND-CP, it is stipulated that:
- In the case of a change in the household business owner, the household business must submit a dossier notifying the change in business registration content to the district-level business registration authority where the business was originally registered. The dossier includes the following documents:
+ Notification of change in the household business owner signed by both the former and the new household business owner or by the new household business owner in the event of a change due to inheritance;
+ Sales contract or documents proving the completion of the sale in the event of selling the household business; donation agreement in the case of gifting the household business; a copy of the document confirming the legal inheritance rights of the heir in the case of a change due to inheritance;
+ A copy of the family members' meeting minutes regarding the change in the household business owner in the case where family members are registered for the household business;
+ A copy of the authorization document from family members authorizing one member to be the household business owner in the case where family members are registered for the household business.
After the sale, donation, or inheritance of the household business, the household business is still responsible for any debts and other financial obligations incurred before the transfer date of the household business, unless otherwise agreed by the household business, the buyer, the recipient, the heir, and the creditors of the household business.
- Upon receipt of the dossier, the district-level business registration authority shall issue a receipt and grant a Certificate of Household Business Registration to the household business within 3 working days from the date of receipt of a complete dossier. If the dossier is incomplete, the district-level business registration authority shall notify the household business in writing of the specific content that needs amendment or supplementation within 3 working days from the date of receipt of the dossier.
Within 3 working days from the date of issuance of the Certificate of Household Business Registration in the event of a change of the household business headquarters' address, the district-level business registration authority of the new address must notify the previous district-level business registration authority where the household business was registered.
- When receiving a new Certificate of Household Business Registration in the event of a change in the business registration content, the household business must return the old Certificate of Household Business Registration.
Thus, the procedure for registering a change in the household business owner is carried out as per the above stipulations.
