Penalties for Disclosing Case Information of Individuals Without Their Consent or Legal Permission

According to the provisions at Point d, Clause 3, Article 10 of Decree 82/2020/ND-CP, acts of "disclosing information about an incident or individual without the consent of the individual or as not permitted by law" will be subject to a fine ranging from 7 million to 10 million VND. To be specific:

"3. A fine ranging from 7,000,000 VND to 10,000,000 VND shall be imposed for any of the following acts:

d) Disclosing information about incidents, individuals, or organizations requesting legal advice, except in cases where the individual or organization requesting legal advice agrees or other provisions of the law apply;"

Additionally, violators of the above act will also be subject to supplementary penalties as stipulated at Point b, Clause 4, Article 10 of this Decree. To be specific: "Revoking the legal consultant card or law practice certificate from 06 months to 09 months for violations specified at points a, b, c, and d, clause 3 of this Article;"

Thus, acts of "disclosing information about an incident or individual without the consent of the individual or as not permitted by law" will be fined up to 10 million VND and also have their legal consultant card revoked for up to 09 months.
