Order and Procedures for Business Household Registration
According to current legal regulations, you are 24 years old, therefore you are eligible to establish a household business.
Regarding the procedures for household business registration, Article 71 of Decree 78/2015/ND-CP on business registration issued by the Prime Minister of the Government of Vietnam stipulates as follows:
- First, you must submit the Household Business Registration Application to the district-level business registration authority where the business is located. The content of the Household Business Registration Application includes:
+ Name of the household business, business location address; phone number, fax number, email (if any);
+ Business activities;
+ Amount of business capital;
+ Number of employees;
+ Full name, signature, residential address, and number and date of issuance of the citizen identification card or valid identity card or passport of the individuals establishing the household business, for a household business established by a group of individuals, or of an individual for a household business established by an individual, or of the family representative for a household business established by a family.
Note:
Attached to the Household Business Registration Application must be a legitimate copy of the citizen identification card or valid identity card or passport of the individuals participating in the household business or the family representative and a legitimate copy of the minutes of the group meeting regarding the establishment of the household business in the case of a household business established by a group of individuals.
- Upon receiving the application, the district-level business registration authority issues a Receipt and provides the Certificate of Household Business Registration to the household business within 3 working days from the date of receipt, if the following conditions are met:
+ The business activities are not in the category of prohibited activities;
+ The proposed name of the household business complies with the provisions of Article 73 of this Decree;
+ The registration fee is paid in full as prescribed.
Additionally, if the application is not valid, the district-level business registration authority must notify the applicant in writing of the specific amendments or supplements required within 3 working days from the date of receipt.
If after 3 working days from the date of submitting the household business registration application, the Certificate of Household Business Registration is not received, or no notice requesting amendment or supplementation of the registration application is received, the household business registrant has the right to file a complaint according to the provisions of the law on complaints and denunciations.
Monthly, during the first working week, the district-level business registration authority sends a list of household businesses registered in the previous month to the same-level tax authority, Business Registration Office, and provincial-level sector management authority.
