Is there any fine for failure to register a death certificate for a deceased person in Vietnam? What are regulations on jurisdiction and procedures for registering a death certificate in Vietnam?

Near my house, there is a case where someone died but their family members haven't registered the death certificate. It has been over two months since then. The police have not yet imposed a penalty. Is this legally correct?

According to Clause 3.b, Article 41 of Decree 82/2020/ND-CP, the following acts of violating the regulations on registering a death certificate are punishable:

1. Fine of VND 1,000,000 to VND 3,000,000 for the act of erasing, amending, or making false content in documents issued by agencies, organizations, or competent persons to perform the registration of a death certificate.

2. Fine of VND 3,000,000 to VND 5,000,000 for one of the following acts:

a) Giving false testimony for another person to register a death certificate.

b) Providing false information or documents to be registered for a death certificate.

3. Fine of VND 10,000,000 to VND 20,000,000 for one of the following acts:

a) Registering a death certificate for a living person.

b) Not registering a death certificate for a deceased person to profit.

c) Providing false information or documents when registering a death certificate to profit.

4. Additional penalty:

Confiscation of the object of the offense, which is the document or document that has been erased, amended, or made false content, for the act of violating the provisions of Clause 1 of this Article.

5. Measures to remedy the consequences:

a) Recommending that the agencies, organizations, or competent persons consider and handle the documents or documents that have been issued due to the violations specified in Clauses 1 and 2, Points a and c, Clause 3 of this Article; documents or documents that have been erased, amended, or made false content specified in Clause 1 of this Article.

b) Force to return illegal benefits.

Therefore, in principle, failure to register a death certificate for the purpose of profit will be fined, while other cases may be forgotten or for other reasons without signs of profiteering, they will not be subject to this sanction.

What are regulations on jurisdiction and procedures for registering a death certificate in Vietnam?

Pursuant to Article 32 and 34 of the Law on Civil Status in 2014 stipulating as follows:

Competence to register death

Commune-level People's Committees of the last places of residence of deceased persons shall register their death. If the last place of residence of the deceased person cannot be identified, the commune-level People's Committee of the place where such person dies or his/her body is found shall register his/her death.

Time limit and responsibility for death registration

1. Within 15 days after the date a person dies, his/her spouse, child, parent or another relative shall register his/her death; for a deceased person without any relative, a representative of a related agency, organization or person shall register his/her death.

2. Justice and civil status officers shall regularly examine and urge death declaration for deceased persons; in case no responsible person can be identified for death declaration, justice and civil status officers shall register death.

Death registration procedures

1. Persons responsible for death registration shall submit declarations, made according to a set form, and death notices or other substitute papers to the civil status registration agency.

2. Immediately after receiving papers specified in Clause 1 of this Article, if seeing that the death declaration is proper, the justice and civil status officer shall record the death declaration contents in the civil status book and together with the death declarant sign in the civil status book and report to the chairperson of the commune-level People's Committee to issue an extract to the death declarant.

The justice and civil status officer shall close civil status information of the deceased person in the electronic civil status database.
