Is it necessary to report to the state agency when leasing a private enterprise?
According to Article 191 of the Enterprise Law 2020 regarding the leasing of private enterprises, it is stipulated as follows:
The owner of a private enterprise has the right to lease their entire private enterprise but must notify in writing and attach a notarized copy of the lease contract to the Business Registration Authority and the Tax Authority within 03 working days from the effective date of the lease contract. During the lease period, the owner of the private enterprise still bears legal responsibility as the owner of the private enterprise. The rights, obligations, and responsibilities of the owner and the lessee in relation to the business activities of the private enterprise are stipulated in the lease contract.
Thus, when leasing a private enterprise, the owner of the private enterprise must notify in writing and send a notarized copy of the lease contract to the following units:
- Business Registration Authority;
- Tax Authority.
Submission deadline: 03 working days from the effective date of the lease contract.
