In Probationary Period, Is One Entitled to 3 Days' Paid Leave for Marriage?
Article 115 of the Labor Code 2019 (Effective from January 1, 2021) stipulates as follows:
Employees are entitled to take personal leave with full pay and must notify the employer in the following cases:
Marriage: 03 days of leave.
According to this Code, an employee is a person who works for an employer pursuant to an agreement, is paid, and is subject to the management, administration, and supervision of the employer.
Thus, conceptually, the Labor Code 2019 has changed, omitting the phrase "working under a labor contract" compared to previous regulations.
From this, it can be understood that, in the absence of any other guidance, the above provision can be interpreted to mean that probationary employees can still take 3 days of leave with full pay for marriage.
