If business households in Vietnam stop operating for one year, have their business household registration certificates revoked?

Pursuant to Point b, Clause 1, Article 93 of Decree 01/2021/ND-CP stipulating the cases of revocation of business household registration certificates:

b) The business is suspended for more than 06 consecutive months without notifying the district-level business registration authority where the business household was registered and the tax authority;

Pursuant to Point c, Clause 1, Article 63 of Decree 122/2021/ND-CP regulating violations of the reporting information regime of business households as follows:

1. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following violations:

a) Failure to submit a business report at the request of the district-level business registration authority;

b) Changing the household business’s owner without submitting an application for changes to household business to the district-level business registration authority where the household business is registered;

c) Suspending or resuming business ahead of schedule without sending a written notification to the district-level business registration authority where the household business is registered;

According to this Article, if you stop business activities without notifying the authorities, the Business Household Registration Certificate will be revoked. In addition, the offenders shall be subject to a fine of between VND 5,000,000 and VND 10,000,000 in accordance with Vietnamese law.

Is it possible to re-grant a Business Household Registration Certificate in Vietnam after being revoked?

Pursuant to Clause 1, Article 94 of Decree 01/2021/ND-CP stipulates the cases of re-granting the Business Household Registration Certificate as follows:

1. In case a certificate of household business registration is lost, burned, damaged, or otherwise destroyed, the household business may submit an application for reissuance of the certificate of household business registration to the business registration authority of district where the household business is headquartered. The district-level business registration authority shall consider re-issuing the certificate of household business registration within 03 working days from the receipt of the application.

Thus, the case of revocation of the Business Household Registration Certificate does not fall into the above cases, so it will not be re-issued in Vietnam.
