Guidance on Updating Company Address Due to Administrative Boundary Changes

Please guide me on the procedure for submitting a notification to update my company's new address due to the establishment of Thu Duc city, which has resulted in changes to the administrative boundaries.

Pursuant to the provisions at Point a, Clause 2, Article 15 of Circular 20/2015/TT-BKHDT:

In the case where an enterprise only updates or supplements information regarding the phone number, fax number, email, website, address of the enterprise due to changes in administrative boundaries or updates information about identification cards, address of individuals in the Enterprise Registration Certificate, the enterprise shall submit a Notification according to the form specified in Appendix II-5 attached to this Circular to the Business Registration Office where the enterprise's head office is located. The Business Registration Office shall receive the notification and issue the Enterprise Registration Certificate to the enterprise.

However, currently, the Notification Form in Appendix II-5 issued along with Circular 20/2015/TT-BKHDT has been replaced by the Notification Form for supplementing and updating enterprise registration information (form Appendix II-5 issued along with Circular 02/2019/TT-BKHDT).

Therefore, the procedure for notifying the company's address update when changing administrative boundaries shall be carried out as follows:

The enterprise shall submit 01 dossier to the Business Registration Office - Department of Planning and Investment where the enterprise's head office is located, including:

- Notification of supplementing and updating enterprise registration information (form Appendix II-5 issued along with Circular 02/2019/TT-BKHDT);

- If the person who submits the dossier is not the legal representative, there must be a power of attorney for the person submitting the dossier and receiving the results (not necessarily notarized or certified) (Clause 1, Article 12 of Decree 01/2021/ND-CP).

At the same time, present a valid copy of one of the personal identification documents of the authorized person (if any) (Article 11 of Decree 01/2021/ND-CP):

+ For Vietnamese citizens: Valid Citizen Identity Card or valid Vietnamese Passport.

+ For foreigners: Valid foreign Passport or valid substitute document for foreign Passport.

Processing time: Within 03 (three) working days from the date of receipt of a complete dossier. (Clause 1, Article 33 of Decree 01/2021/ND-CP).
