Draft: There will be a network of consultants on human resources, finance, production, sales, marketing, and internal management for the cooperative in Vietnam

Pursuant to Clause 3, Article 7 of the Draft Decree guiding the Law on Cooperatives (amended), the policies on supporting consultancy for cooperatives will have the following contents:

- Cooperative groups, cooperatives and unions of cooperatives approach the network of consultants for support in using consulting services on human resources, finance, production, sales, markets, internal management and other contents related to production and business activities of cooperative groups, cooperatives and unions of cooperatives.

Note: Not including advice on administrative and legal procedures in accordance with specialized laws.

+ Support 100% of consulting contract value but not more than 50 million VND/year/cooperative for cooperatives or not more than 70 million VND/year/cooperative for micro-cooperatives owned by women, micro-cooperatives employ many female workers;

+ Support up to 50% of the consulting contract value but not more than 100 million VND/year/cooperative for small cooperatives or not more than 150 million VND/year/cooperative for small cooperatives owned by women, small cooperatives employ many female workers;

+ Support up to 30% of the consulting contract value but not more than 150 million VND/year/cooperative for medium cooperatives or not more than 200 million VND/year/cooperative for medium cooperatives owned by women, cooperatives have used many female workers.

What documents should be included in the draft application for registration to the consultant network for cooperatives?

Pursuant to Clause 2.b, Article 7 of the Draft Decree guiding the Law on Cooperatives (amended) stipulating application for registration to the consultant network for cooperatives as follows:

2. Network of consultants

a) The network of consultants is built on the basis of individuals and consulting organizations that have been operating in accordance with specialized laws or newly formed, ensuring the following principles:

For individual consultants, they must ensure that their training, professional qualifications and working experience are suitable to the needs of cooperative groups, cooperatives and unions of cooperativesss and criteria for consultants of the ministry or ministerial-level agency where the consultant is expected to register.

For a consulting organization, it must satisfy the conditions prescribed by specialized laws and meet the needs of cooperative groups, cooperatives and unions of cooperatives and criteria on consulting organization of the ministry or ministerial-level agency where the consulting organization is expected to register.

b) Application for registration in the network of consultants

For individual consultants, the dossier includes: Application form to join the network of consultants; Curriculum Vitae and summary of qualifications; certified copies of training diplomas; certified copies of relevant documents and papers issued by competent authorities.

For consulting organizations, dossiers include: Application form to join the network of consultants; a certified copy of the Certificate of Business Registration or the Decision on Establishment; capacity summary profile; certified copies of records of individual consultants of the organization; Certified copies of documents and papers proving satisfaction of business conditions as prescribed by law (for enterprises conducting conditional business lines).

c) The consulting individual or organization shall submit the dossier specified at Point b of this Clause either directly or online to the unit assigned to organize the operation of the network of consultants under the ministry andministerial-level agencies to be recognized into the network of consultants and published on the website of the ministry or ministerial-level agency within 10 working days.

In case an individual or a consulting organization is not qualified to be accredited,
The unit assigned to act as the focal point for organizing the operation of the consultant network under the ministry or ministerial-level agency shall send a notice of the reason for ineligibility through direct or online form to the consulting individual or organization within 10 working days from the date of receipt of registration documents.

Consulting individuals and organizations may join the network of consultants of many ministries and ministerial-level agencies if they satisfy the conditions and criteria as prescribed.

Thus, the application file for registration to the network of consultants for cooperatives includes the following documents:

- For individual consultants, the dossier includes:

+ Application form to join the network of consultants;

+ Curriculum Vitae and summary of qualifications;

+ Certified copies of training diplomas;

+ Certified copies of relevant documents and papers issued by competent authorities.

- For consulting organizations, the dossier includes:

+ Application form to join the network of consultants;

+ A certified copy of the enterprise registration certificate or the establishment decision;

+ Profile summary of capacity;

+ Certified copies of records of individual consultants of the organization;

+ Certified copies of documents and papers proving satisfaction of business conditions as prescribed by law (for enterprises conducting conditional business lines).

In the near future, what criteria should cooperatives meet in order to receive support policies from the State of Vietnam?

Pursuant to Article 4 of the Draft Decree guiding the Law on Cooperatives (amended) stipulating criteria for enjoying the State's policies on cooperative development as follows:

Criteria for benefiting from State policies

Cooperative groups, cooperatives and unions of cooperatives are entitled to receive support policies of the State when meeting the following criteria:

1. Have a financial statement audited by an independent audit unit within 12 months from the time of requesting support for policy content with funding from the State budget of at least VND 03 billion for a group of cooperatives, cooperatives, unions of cooperatives.

2. Meet at least one of the following criteria:

- Have a growth rate of the number of members annually for 3 consecutive years above 5% by the time of requesting support.

- Have an annual rate of internal transaction value that has increased continuously for 3 years up to the time of requesting support.

- Have an annual rate of setting up an undivided common fund or developing an undivided common property of 10% or more continuously for 3 years up to the time of request for support.

- Organize education, training, dissemination and retraining for at least 10% of the total number of official members annually for 03 consecutive years up to the time of request for support.

Thus, a cooperative is entitled to the State's policy on cooperative development when it meets the following conditions:

- Have a financial statement audited by an independent audit unit within 12 months from the time of requesting support for policy content with funding from the State budget of at least VND 03 billion for the contract.

- Meet at least one of the following criteria:

+ Have a growth rate of the number of members annually for 3 years continuously over 5% by the time of requesting for support.

+ Have an annual rate of internal transaction value that has increased continuously for 3 years up to the time of requesting support.

+ Have an annual rate of setting aside an undivided common fund or developing an undivided common property of 10% or more continuously for 3 years up to the time of request for support.

+ Organize education, training, dissemination and fostering for at least 10% of the total number of official members annually for 03 consecutive years up to the time of request for support.

The draft Decree guiding the Law on Cooperatives (amended) is still being consulted and has not yet entered into force.
