Can a household business operate in multiple locations?
I plan to start a household business for producing handicrafts soon. I am unsure whether I can operate at multiple locations or if it has to be at the place where I registered?
Answer:
Based on the provisions of Article 86, Decree 01/2021/ND-CP, the location of a household business is defined as follows:
The business location of a household business is where the household business conducts its business activities.
A household business may operate at multiple locations but must select one location to register as the household business headquarters. It must notify the Tax Authority and the Market Management Authority where the business activities will take place for the remaining business locations.
Thus, under this regulation, a household business can operate in multiple locations but can register its headquarters at only one location.
When can a household business start operating?
Regarding the regulations on the operation of household businesses, when is a household business allowed to begin operations according to the law?
Answer:
Clause 3, Article 82, Decree 01/2021/ND-CP stipulates:
Information on the Household Business Registration Certificate is legally valid from the date the certificate is issued, and a household business has the right to operate from the date the Household Business Registration Certificate is issued, except for those investing in conditional business sectors and professions. If a household business registers a start date for its business activities later than the issuance date of the Household Business Registration Certificate, it has the right to operate from such registered date, except for those investing in conditional business sectors and professions.
Therefore, according to the above regulation, a household business is allowed to operate from the date the authorized agency issues the Household Business Registration Certificate. This regulation does not apply to conditional business sectors and professions.
Do street vendors need to register as household businesses?
If I sell items as a street vendor with no fixed selling location, am I required to register as a household business? Thank you.
Answer:
According to Clause 2, Article 79, Decree 01/2021/ND-CP:
Households engaged in agricultural, forestry, fisheries, or salt production, and individuals who are street vendors, itinerant salespeople, or those conducting mobile, seasonal business or low-income services are not required to register as a household business, except for those engaged in conditional business sectors and professions. The People’s Committees of provinces and centrally run cities determine the low-income threshold applicable within their jurisdiction.
Thus, according to these regulations, street vendors are not required to register as household businesses.
