Are public school teachers eligible for support under Resolution 116?

I am a public employee, a teacher at an elementary school. I am unsure whether I am eligible to receive support under Resolution No. 116.

According to Article 2 of the Public Employee Law 2010, a public employee is a Vietnamese citizen recruited according to the job position, working at a public service provider under contractual policies, receiving salary from the public service provider’s salary fund as prescribed by law.

In Clause 1, Article 1 of Decision 28/2021/QD-TTg (guiding Resolution 116/NQ-CP of 2021), it is stipulated regarding the beneficiaries of support, including:

Employees participating in unemployment insurance as of September 30, 2021 (listed in the unemployment insurance participation list of the social insurance agency), excluding the following cases:

+ Employees working at state agencies, political organizations, socio-political organizations, or people’s armed forces units.

+ Employees working at public service providers that are regularly funded by the state budget as stipulated in Decree 60/2021/ND-CP dated June 21, 2021, by the Government of Vietnam, regulating the financial autonomy mechanism of public service providers and the current regulations on financial autonomy of public service providers.

Therefore, teachers who are public employees in public service providers regularly funded by the state budget will not be eligible to receive support from the Unemployment Insurance Fund. Hence, you need to compare the above regulations with your specific case.

Note: If your unit is a different public service provider not regularly funded by the state budget under Article 9 of Decree 60/2021/ND-CP, you may still receive support if you are participating in unemployment insurance as of September 30, 2021.
