Are laser guns a toy for children in Vietnam? How much is fine for letting children play with toys shaped like guns in Vietnam?

Hello, I have a problem that needs to be answered. Recently, on July 3, I went back to my grandfather's hometown to join his death anniversary. While I was playing with my younger siblings at home, Tin brought a toy gun out to play with. That gun will have a laser shot out every time he pulls the trigger. I advised Tin to stop playing with that gun because it's too dangerous, what if he shoots them in the eye? I'm really curious that the law doesn't have any regulations on children's toys, such as Tin's laser gun. I really hope a lawyer can answer this issue, thank you.

In Section X, Part One issued together with Decision 88/2000/QD-BTM in 2000 stipulates that some types of childrens toys harmful to the ethical education and/or health of children or detrimental to social security, order and safety:

1. Various kinds of gun-like toys:

- Compressed air or spring guns shooting plastic bullets or other kinds of bullets.

- Water or steam spraying guns; guns emitting light or making explosion.

2. Toys with shape resembling other kinds of weapons:

- Those resembling grenades, bombs, mines, explosive charges.

- Those resembling swords, spears, bayonets, knifes, bows or crossbows (made of various kinds of materials including wood, bamboo, pressed paper...).

3. Pyrotechnic articles of all kinds: firecrackers, fireworks, self-igniting firecrackers and self-igniting projectile made with gun powder or other materials that can cause fire and burning.

4. Illusory toys of various kinds.

5. Toys in form of cultural products (printed matters, tapes, disks), electronic toys featured with images, sounds or actions describing human fighting and killings in a barbarous manner or acts offending human dignity, destroying environment, which are harmful to the aesthetic and ethical education of children.

6. Computer game software with pro-violence or prostitution contents.

7. Electrically-operated toys with remote controls that can cause interference to other appliances or equipment, or unsafe to children.

8. Toys bearing the national flag or map of Vietnam, or images of leaders in contravention of the regulations or intended for malicious purposes.

Thus, according to the above regulations in Vietnam, laser guns are children's toys, but they are harmful to character education, children's health or to social security, order and safety. In this case, you should discuss with Tin's parents about how dangerous the laser gun is and what the punishment will be if they let Tin continue to play.

How much is fine for letting children play with toys shaped like guns in Vietnam?

According to Clause 1 and Clause 7, Article 11 of Decree 144/2021/ND-CP regulating vsome tyiolations against regulations on management and use of weapons, explosive materials, explosive precursors, combat gears, fireworks, firecrackers, and dangerous banned toyspes of childrens toys harmful to the ethical education and/or health of children or detrimental to social security, order and safety are as follows:

1. A fine ranging from 1.000.000 VND to 2.000.000 VND shall be imposed for any of the following violations:

a) Failure to implement or promptly and fully implement regulations on periodic inspection of weapons and combat gears issued;

b) Failure to fully declare and register weapons and combat gears to competent authorities;

c) Violating regulations on preservation of weapons and combat gears;

d) Using or allowing children to use dangerous banned toys;

dd) Circulating expired licenses, confirmations, certificates, qualifications relevant to management and use of weapons, combat gears, fireworks and firecrackers.

7. Additional penalties:

a) Confiscation of the exhibits and means of administrative violations for the violations specified in Points d and dd Clause 1, Points a, b, c, e and g Clause 2; Points a, c, d, dd, e, h, i and k Clause 3; Points a, b, c, d, dd, e, h and I Clause 4 and Clause 5 of this Article;

b) 3 – 6 months suspension of the license for use, certificate of registration of weapon or combat gear in case of violations specified in Point e Clause 2 of this Article;

c) 9 - 12 months suspension of the license, certificate of weapon, combat gear or fireworks in case of violations specified in Point a Clause 2, Points b and k Clause 3 of this Article.

Pursuant to Clause 2, Article 4 of Decree 144/2021/ND-CP regulating fine levels:

2. The fines specified in Chapter II of this Decree are imposed upon administrative violations committed by individuals. The fine imposed upon an organization for the same violation shall be twice the fine imposed upon an individual.

Therefore, letting children play with toys shaped like guns will result in an administrative fine of between 1,000,000 VND and 2,000,000 VND. There is also an additional penalty of having the toy confiscated in Vietnam.
