Are General Partners Eligible for Social Insurance Contributions?
According to Clause 1(d) Article 2 of Decree 115/2015/ND-CP, business managers and managers operating cooperative societies who receive a salary are subjects of compulsory social insurance participation.
According to Clause 18 Article 4 of the Law on Enterprises 2014:
A business manager is a person who manages a company and a private enterprise, including the owner of a private enterprise, a general partner, the Chairman of the Members' Council, a member of the Members' Council, the Chairman of the company, the Chairman of the Board of Directors, a member of the Board of Directors, the Director or the General Director, and individuals holding other managerial positions with the authority to represent the company to sign transactions of the company in accordance with the company's charter.
Thus, salaried general partners are required to pay compulsory social insurance. If not salaried, they are not required to pay compulsory social insurance.
